Try to explain that to the USPTO. I've spent thousands on rejected for trademarks throughout my years to know what business names you can use and can't.

Trademarking it has a higher standard than simply using it in the name of your business. The Volkswagen mechanic wouldn't have been able to trademark his business name, but he was absolutely allowed to use it.
