well yea, i certainly dont plan on sending them anything. and it was a red flag to me that they said they verified it was fake when they bought the item from me for $50.99 but didnt offer a name used or date for it. also, none of the buyers i have look suspicious (zero feedback, 20 zumbas bought, etc). especially when i verified that i didnt sell one for that amount. it makes me think this is another generic letter they send to everyone. but yea, i obviously wouldnt send them anything.

they also included 3 previous verdicts where they screwed people who were selling the same items. i guess i just need to sit and wait and see if my bank account gets seized

I would write them back and say that you are unaware of what they are talking about so you have no way of sending them anything. If they would like to provide YOU with further evidence as to their inquiry to please do so, and if they do not do so in writing within 10 business days that you are going to CC a copy of all materials to the FTC and State Bar Panel for review of ethical legal practice. See who shits their pants then when their license to practice is on the line.

it seems like a scare tactic but if you know they are fake i would stop. most companies try to scare first to save the money but will come after you if that doesn't work

unless you are making a ton of money off of them, they are probably not going to sue you. your average lawyer is $200+ an hour. plus court costs etc.

I only read the first 5 or so posts, but dude, don't respond. Lawyers are dirty motherfrickers and if they wanted to get you, and really had you, you would have been served.

There are so many people on the internet doing the exact same thing as you, so many that to pursue any action against someone who isn't making millions not worth it. and who are all powerful, will not waste resources on someone casually selling their customer's brand name illegitimately. That firm costs about 2k an hour, less than a thousand a week is a waste of time for them in terms of sales.

They do however, send out emails, hoping people respond with information that makes it easy for them to file suit. The people who respond with said information are suckers, and they make examples out of them to protect their client.

It's not worth it for a private company to spend the money it takes to trace someone over what to them is small amounts of money. But they do like to throw hooks out there. Those are cheap, and the fish they catch are freebies. It's not worth it to go after the "little guy." They want the wholesalers and manufacturers.

Basically, don't panic, that's my #1 rule. #2 is don't fall for that shit they try to pull.

What ever it is, it is scary and the best way is to avoid selling these things. So many other people are doing the same thing but they also might get same problem one day!

Read the email and see if he/she knows your name, if not then it's just a spam and pretends to use other people name to make fun of other people. If he/she knows your name, just reply back and tell him that you are not selling fake stuff.

After reading your email, my advice is don't respond. If a lawyer was really serious about the lawsuit, you should have received a letter through the mail by now for anything pertaining to copyright infringement. Just don't sell anything fake on eBay or online to avoid this type of situation. Often times, these companies will buy undercover as a buyer and this is how they get some people selling counterfeit.
