Am I breaking the law?

This may be a dumb question but im worried.

Im currently marketing a Fiverr Alternative site (SellAndDeal), and im doing this by messaging people on different gig sites (ive messaged over 3k users so far), and im wondering if what im doing is legal? Ive heard that email/text spamming is illegal but would messaging thousands (one message per person) of people be considered spamming?
 
If whatever your selling on fiverr is legit, Then mass emails is not illegal. but it is spamming.
 
If you are using the sites messaging system rather than email/sms, you are in the clear. Keep on spamming, brotha!
 
The laws are about email/sms/faxing and then only a few countries have the laws, so you are good to go.
 
You're breaking the terms of services of the sites that you're using, of course, but not breaking the law.
 
You are breaking the TOS but not the law dude, just keep keep doing what you are doing if its make you $$
 
Most of this sites members would be doing hard time if it was.
 
there is no law your breaking but possibly the TOS of fivver, worse case scenario, they bann you, thats it

Why would you ask for legal question on a blackhat forum? The issue with asking is you have users from different countries, different ages and different experiences so the kind of response you get from a 17 year old kid in a developing country who is trying to "help" vs. an experienced businessman in the US will be completely difference.

Responses like "If you are using the sites messaging system rather than email/sms, you are in the clear. Keep on spamming, brotha!" - rarely accurate. The law is almost always grey so the answer to questions like this is usually "it depends...". If what you are selling on Fiverr is legit and not illegal then I don't see where you are breaking the law however you are spamming by doing what you are doing with the emails which could have some kind of affect if people either report or class you as spam.
 
Sending the same message (or maybe with a bit of spinning) to thousands of people, IMO, would obviously be considered as spamming.
