Advice Please: Lawyers threatening me for using "their" domain name

i can tell you from experience that lawyers make money litigating. offer to sell it to them for $10.00 and they will FIND a way to get their clients to decline the offer through some legalise; ostensibly through defense of brand integrity. they want and need the fight. if they win you will end up with a judgement and have to pay their fees.

whether the judgement is enforceable or not will be up to you, but the point of the post is to remind people that they WANT you NOT to comply. Their base salary for "in house" positions is reduced when they are not litigating. Assuming they are a nationwide brokerage it is safe to say that they are already on the payroll.

fight it if you want the domain, but be aware of the mechanics of your fight.
 
So are you suggesting I agree to the $500 USD settlement? Why should i sell it for $10 if they're offering $500 (and in fact I wouldnt mind $1000)?

I'd take the $500 if I were you. It's probably more than you would have got from IMing the domain, with minimal effort. Plus it's a .info, thats $499 profit :D

Tell me what the domain is though..I'm curious as to who the company is.
 
Common.. stop crying any more and accept 500$.

Its waste of time fighting. And if something goes wierd in meantime you have to pay thousands of $$.

Give them but represent them saying 500$ is very less as you can earn more Pounds in longterm. But some where in heart prepare for 500$.
 
If it was me, I would just hand them the domain and let go and move on, not because I got scared, but my lifestyle is simple and I don't like creating problems.

dude, you practically have guaranteed 500$. Now you can get a lawyer thats specialized in international online trademark stuff, show him what they say, and ask him if you should take the 500$ or go for more. He get's his 100$ or whatever he wants for his advice, and you still have your 400$ plus if they are just bluffing a lot more money. I say that because since they are offering you money AND say the law is on their side... something MUST be wrong. If the law is on their side, they would fight, not pay. So check it out with a specialized lawyer. You got nothing to lose now... if my advice was getting you a lot more money, consider dropping me 10% :D
 
Accept the $500, you practically gained all the money that adsense site was going to make for you without doing seo or a great campaign. And you win!
 
take the $500, the offer could just as easily be rescinded and you would have nothing but a headache
 
I have had this happen quite a few times. I simply asked them to send me the legal documentation showing the registered trademark. Fortunately in some cases there was no trademark for the domain I owned. :) On another occasion the domain was in fact a registered trademark and I did comply. However the owner did not follow through with the transfer and I still own it :) I believe that they would have to own the trademark in the UK for them to legally take the domain from you.

If it is a new domain and you don't want issues I would just request the legal information for the trademark and if they do respond with the proper documentation surrender the domain name.
 
Take the money and run to the hills :).
I think $500 for a start-up .info is a great business.

Settlement fee agreed! But the best bit is that i denied their offer of $500 and got them to push it up to $800 !!!

i had a simliar issue WAAAAY back. I wrote back and said when i see a S&D from a judge I will shut it down. I dont think ican was in effect at the time. It was over a domain publishing clips from banned from tv vhs it was so long ago. I would find out if icann can legally just bill you the fee or not. Im not paying them shit and im not leaving my desk unless thers a court order
