Hi,

Ive a adult tube hosted on a dedicated server (kimsufi-OVH). I live in europe, netherlands. As traffic and earnings are growing i wondered if there are legal risks. Users can upload content, it is moderated though, so not automaticly posted. 80% of all content is non-proffesional (cam, selfie etc.).

People can report content, then it will be taken down, this is also explained at DMCA page.

Are there any large risks? Should i buy / move to a server/domain hosting under a false name? Whats wise?
 
Well it depends on what you want to do.

You need to choice, you can't be responsible for what users make upload. But you can help and prevent that happening, by deleting the videos if you receive any abuse/dmca.


Otherwise, if you want a freedom content and make a community that can share their videos of CAM4, Chaturbate for example with DMCA content you should move to Offshore Hosting.

The risks is more high when someone post a video of people with less than 18 years, or when she/he don't know when was being filmed.

But if you want to share video like cam4, chaturbate videos you have filmed you shouldn't have a big problem with that, the big problem is on "amateur content".

For example, you have a complete video from a cam girl of CAM4 and you (or user) post the entire video on your website, you shouldn't have any problem. You can still receive DMCA but isn't "illegal" at all, because she/he is exposing on Public, and they know everyone is seeing what they are doing, so they have "consciousness" of what they are doing.

In my opinion you should create a Offshore Company and use that information about company to register domain, let's say a "ghost company" you can do it and you will be more safest.

Try opening a Offshore Company on Seychelles, Panama you can do it, in the same if you live in the country or outside, you can do it from anywhere.

So, in my opinion you should create a offshore company and use that details on whois.

Move your domain and files to offshore hosting.
