Hello guys,I am planning to open a porn blog and i wanted to ask is adding a dmca to site advisible or not ?
I researched a bit and most of the big blogs don't have dmca.
Well i will be sharing porn clips from different sites like brazzers etc.

The fact you asked means you already know the answer. You seem content in sharing content you don't own, so you're already admitting to sharing copyrighted content. Aim for something else rather than a hopeful lawsuit if you get big.

The odds of you getting a DMCA notice? Very low, unless you're pushing huge traffic and/or allowing downloads directly from your servers, but be safe. You can find a shitload of un-copyrighted/amateur material to share instead, or just use outside sources.
 
in extreme cases even though you are just linking, your website will also be forced to be taken down unless you are on host that ignore these notices.
 
in reality, according to US law.. the normal procedure is that...you should receive a notice to take down the stuff that someone claims copyright for..
only if you failed to follow those instructions can someone sue you , if someone sued you right off the bat, just ignore that notice , they are just messing with you.

if you want to promote brazzers , check if they have an affiliate program..
 
The main fact is that i will not be hosting those stuffz on my servers and ya i will be using offshore servers...Basically i would be leeching those stuffz from other blogs and forums only..If i have notice for that i will remove those content asap...

ok . i read more on this.. this is how dmca works..

you have a site that provides a platform for people to upload stuff.. then you can have a DMCA section where copyright owners can notify you of a infringement and that way the providers of the platform can take down the video/image etc.,

so you as a blog owner cannot have a dmca section as your blog doesn fall under this category.. you put up content on your own so you are liable if they chose to come after you..

but rules are more laxed in porn lol ( i guess).. reason being.. they make a lot of money anyways.. that they wont be coming after you like some sketchy law firms or photographers who have no money and crawling the internet to find pple and sue them..

you know what i mean ? its not worth the hassle for them..
i dunno if i made any sense to you .. just threw out what i know on this.. hope it helps !

and mostly if you are outside US you are pretty much ok .

i have seen a lot of adult free sites with tube site contents and i dont think tube sites have a problem with that.. they like it i guess cause they allow you to embed their videos for free.

even if you put up links on your site that plays the video on their website it should be ok..

and in this particular case.. if you put a brazzers paid content video on your blog.. THAT can be a problem in particular lol.

but the other two points i have made before is ok, and at the end of the day.. as long as you comply to their request. you should be fine.

I was always under the assumption that a DMCA was only needed if you were allowing people to upload content to your site.
 
The DMCA is meant to protect you as a site owner from being liable for anything your users upload. In this case you're the one publishing the content, so you're the thief.

And copyright is a pretty big issue in adult right now. It used to be extremely lax, but there's a real movement among the companies to go after everyone.
 
One thing that comes to mind is were you are getting your content. For the most part you can get everything you want from any of the major sites under there "webmaster" programs. I might be missing something here but if you are using that you are fine.
 
I agree, porn isn't that lax currently. But it's fluid as every now and then owners (re-)realize that viewers follow watermarks to get even more similar stuff and become clients this way. It's a complex mixture of promoting and unsatiability as the brain rarely likes to see the same clip more than once but always wants similar themed scenes.

If you find an informed enough copyright holder they may even accept you as an aff. But visitors will drop you fast if you try tricks like showing only a teasing 10 minutes 'intro' in the hope that they reach into their pocket as easily as into their underpants.
 
hi, if you pay membership to a site, and you are told download any , any content, does that mean you own the content you have paid for by paying your membership ??

ok for example, i paid membership , i down load the content , i open a blog, can i supply that content under my own domain ? can i supply for free with cpa on the blog. ?

no, i doubt that..
you paid for downloading the content to view, not to resell or share it to others for free..
you have to contact
"content providers"
or production studios..

they will sell you content for which you have the rights for..
you can even watermark those purchased content with your blog title or something.
 
Don't know what others said, so may be someone already suggested this, go OFFSHORE, and you're SAFE! Still just make sure your host allows warez linking.
 
ONE more question ,

porn being free in a vast amount of sites, " how do sites still make money from porn ? "

is it clicks or advertising due to mass traffic or ???

i can get the content ( asian , not on mass ) but is it worth it with soooo much free porn around.
 
By putting advertisements on their sites, simple :)
