Active website on a domain that's for sale

Hi there folks.

I've been looking to buy a certain domain that's for sale on both namecheap and godaddy but when I type it down in the address bar it pops up a website for some media production company.

I'm not very familiar with the domain sale process. I always thought that when a domain is for sale the website on it must be taken down.

I'm a bit confused and not sure if I should go ahead and buy that domain. What do you think? Is it a mistake on domain providers' side or there are no obligations for the domain owner to take down their website when they sell the address?

I buy and sell domains all the time, and have several up for sale that have websites running, rather than parking them.

Once someone buys the domain the site will disappear, as the named servers will change to the new owners, or domain provider defaults. At least it gives you a chance to see if the site is indexed, a good indication there's no penalty.
