What is the content like for each page? If one page is thinner than the other google might be using it as it considers it to be a better resource also make sure in your content for each page are the keywords you're targeting. just a few ideas but hope it helps

They can just file a DMCA complaint again you which eventually if they can prove you've copied them will get your site de-indexed.

I use DMCA and just copy and paste into google, one sentence at a time. It always produces results, there's no need for tools.

It's a good way to hide your footprint from previous work and it's a great way to revive a dead website. If you have an aged Domain then it's a good idea to change email address if you're planning to revive it for its old keywords (I'm currently working on an older website atm).

Thanks guys, it's because the site is already ranking so I wouldn't wanna mess with that too much as I'm making changes anyway. Basically it's the design of the site that gave it the duplicate H1s, I'm just gonna change one of them to a H2 and work my way down. Thanks again

erm... maybe in a long time but from my experience I know that it takes a hell of a long time to gain google's trust again, especially on the same domain. IMO best of starting again with another domain.
