I don't think it is about id3 tags (too easy to be true). I think you're right, the key is 33 sec at the end. I suggest you look closer and test around it on yt editor to reset the claims. Maybe it's both about video and audio claims. Just test with 33 sec of video from TV Tokyo and 33 sec sound...

you can see the author, copyright owner and so on of the video...you can edit these tags

if you still believe it is a loophole, maybe you can look at the id3 tags which is separated from the video itself

It's surprising because from what you say the last user click is from your personal site, so it's programmatically impossible for ebay to see your bing ads.
