You want to know if the website has a penality ? Simple ! Type "site:yoursite.com" in GG and see if results are shown: shown ? No problem ! No results ? You might targetting a sandboxed website :p

No it won't harm your website. But not showing Privacy Policy & Terms & Conditions, etc. will harm your site because GG starts its trust with this kind of pages... As already said, you can noindex these pages, or put "nofollow" attributes on the links to these pages.
