Great that you are motivated man! But careful, he is not making money with Adsense, he is doing it with affiliate links.

ICANN can take the domain from you if you impersonate someone. If you "spin" the content and be smart about how you are writing in the site, I dont see how they can take it from you. But anyways, if you write new content, you also need to explain why you have a domain that match his exact name...

You can restore the content but with a spin on it. I dont mean to spin the content with a tool, I mean just rewriting some stuff, changing some titles, changing the design of the site, stuff like that so its not so obvious.
