Really bad practice. Google will disapprove campaigns like this when they're found. You're better off creating a landing page and mini site with value and linking to the offer naturally from there.

Quality score is based on several factors:
Display URL's previous CTR
Account history - CTR of all ads and keywords
Keyword expected CTR
Landing page quality
Ad relevance to keyword
Keyword relevance to search terms
Geographical performance in regions you target
Site specific / device...

If you are using a DKI such as {KeyWord:Trademark Term}, then when a users search string is too long to fit in your ad, the trademark term will be displayed.

If the Trademark owner files a complaint with Google, they may disapprove your ads or only allow them to appear in certain circumstances. Whether they will do that depends on the size of the company, if you're trying to misrepresent yourself as them, etc.
