For example if i add an affiliate link at the beginning of an anime video or a porn video that isn't mine and upload it to youtube/pornhub. Would I get in trouble?

Lets say I have big amount of emails in a specific niche. Is it legal to just send people affiliate offers or point them to my website with affiliate links in it? I assume the latter would probably be better since affiliate networks usually don't allow email traffic.
