I think they’re able to get approval that effectively removes all brand-related restrictions by appearing to follow the rules—or perhaps they don’t face any restrictions at all. In the past, no one used to use a business logo but now everyone who can run ads on those keywords has a favicon.

Hello, they don’t use a cloaker, but their accounts get suspended every 7 to 10 days. However, they simply buy another old account and use a method that seems like a magic wand, allowing them to get listings for all keywords without any issues.
