There are themes especially those themes that looks really nice which shows error once you removed the links as it has some code the check if the links are there or not. Well there are themes that you can just edit footer.php and remove the links.

Most of my money making blog sites are EMD and I did not experience penalty both from panda and penguin updates. I got like 20+ EMD. For now we can say EMD penalty not the reason why your sites went down on Google.
