I will have to address your points separately.
The use of Linux does not guarantee that you are spyware free. Ubuntu has quite a bit of spyware installed out of the box. Since v 16.04 the spyware is claimed to be disabled by default, but I am skeptical.

Unless you are familiar with a few different programming languages and have personally examined each of the approximately 4 million lines of code in the kernel of Linux, and personally compiled the kernel for your machine, you cannot guarantee that the kernel does not have spyware in it.
After addressing the kernel and having compiled it for your use, you then have to do the same for each of the programs that you would use in Linux. These programs, rather than the kernel, are what most people view as Linux.
Windows server, Windows Vista - W10, can be hardend to the point that they are more secure than Linux. The problem is that up until W10, Windows was not hardend out of the box. W10 has spyware and tracking issues.
Linux is not as secure as many think. There are several known security bugs in Linux.
Microsoft had backported much of the W10 spyware to W8.1, 8.0,7, and Vista. These were installed as updates. The commands below address much of the spyware and remove it. There are also commands that remove the nag and W10 update screens. Most of it addresses removing the Microsoft spyware.

The most secure common (not so common in use) OS is BSD Unix. While OSX is a variant of Mach 3 Unix, OSX also has several security problems.
There is nothing such as perfect security.

Right now i'm using win 8.1 but if i should choose win 7 and 10 i'll go with win 10.
Tried win 10 on my laptop but it's just laggy. the search and start button is just to slow.
can't stand the lag, and so much compability issue

I know classic shell. I was using win 10 for few days with classic shell.
Win 10 boots up very fast.
still i hate win 10.

From comparison between Win 7 and Win 10, 7 version is good and more reliable to use. But 10 has more attraction than 7. Which type you want and install that one.

I think both are pretty reliable. I used Win 7 for years (i skipped Win 8, 8.1 alll together) without a single issue, freezing. I use Win 10 for almost a year now, the same is true what was true for Win 7, no issues so far. From the reliability POV, there's no difference imho.
If you want difference, that's something other than reliability. On Win 10 programs run smoother according to my experience and the system doesn't lag even after not shutting it down for weeks. When i ran Win 7, after not shutting it down for a week or so, it always started to lag a bit, with time it got worse. This is non-existent with Win 10.
All in all Win 10 is a well put together OS (regardless spying) and is superior to Win 7 from pretty much every aspect, it would look pretty bad otherwise.

In my suggestion is windows 10 requires less ram taken compared to windows 7,8

Windows 10 is lot better then windows 7 . I have upgraded my system on windows 10 from windows 7. Win10 is lot faster then window 7 and has its own security system so it can protect our system better. Also it has improved browser Microsoft Edge.
