How do sellers selling restricted items get away with it?

I have identified a fantastic profit to sell on ebay with a lot of profit potential, I also see many other sellers selling this item however I am under the impression it is not allowed under ebay rules.

How do sellers get away with it? Simply just wait until they get caught?

If you get caught you get a warning I assume, if you relist I assume you get banned. Would you then have to remake an account as a work around? Would they ban your paypal?

Yeah more than likely they have multiple accounts, its not something i do but i believe the term is 'stealth accounts'

E Cigs and accessories. There are loads of sellers selling these, some with their accounts based on selling this with thousands of feedback but I read in the rules it isn't allowed and I contacted support who said it wasn't and then removed the listing i had questioned.
 
A while ago, while investigating how to avoid copyright violations, I noticed that a popular dropshipper's products weren't showing up on google. I looked at the source code for their description, but they didn't have any meta tags or the like telling the page not to be indexed, so I didn't figure out how they did it. People need to find your listing before they can realize it's a violation, and making it not appear on google would go a good way toward that. Also, not putting the UPC/MPN/Brand as item specifics is important, as if they have a blacklist of those, then they could have a program running to find illegal listings and remove them.

Ah that is interesting. However I think E-cigs are restricted as per Ebays policy not because of manufacturers making claims. So I am wondering how they are evading Ebay rather than the manufacturer.

Most people that sell items like these, which i refer to as "Vero" items, have multiple accounts. Vero items are constantly taken down by ebay, here is a link if you want to read more about what that means http://pages.ebay.com/help/policies/questions/vero-ended-item.html
Having multiple accounts requires "stealth accounts". These accounts are made very careful, not connecting to you personally, and are supposed to ride under the radar of Ebay. These accounts can be shutdown, and often are eventually, but the fact of the matter is you just replace them. If you are unaware of how to make a stealth account, it would be inadvisable to try to make one yourself, seeing as it is very easy to mess up. There are people that sell these accounts for relatively cheap, compared to the amount of money you will be making on these accounts. I believe there are sellers on this forum that sell such accounts.
 
you see them on the show 'border security' not soon after?
