Getting sued for using an image

Hey everyone,

I have a major problem.... I have used an image from google after filtering by "labeled for reuse". Credit has been given for the image, but on another page.

Now, my client got an email that he has to pay ?1300 because of using that image. What the hell? I thought we can use the image, since it's labeled for reuse and we credit the one taking it.

Does someone have some advice what I should do now? My client told me that we might want to simply wait and see if they take another look to see that credit has been given, so they won't actually sue.

Advice would be really appreciated.... paying that kind of money would be really painful.

Just wait, if they get back to you again just show them you've given them the credit. Hardly anyone ever actually sues.

It's most likely fake, but if it's real. Don't even trip about it. Get a VPN, cloak yourself, then make sure your website is Protected, like The "WhoIS" info.
lol I had so much emails like that, and to be honest I tell them to go fuck themselfs, lmao and then never reply. I never get anything back either.

So don't even worry about it, don't give them your name or anything like that.

I don't have much knowledge about it as I have never been sued but I don't think they can sue you just like that first they should send take down notice if you don't then they can sue also if image was labeled for reuse then do take the print screen and reply to them that it was labeled that way so you used or you wouldn't have if they still want you take it down then just simply take it down get a new from photostock paid one...

Ignore the message. You cannot request a sum of money in the first correspondence regarding a legal dispute. It has to be taken to a legal sue, and so you have to have a court summons or a contracted letter from a legal attorney to request money. All that you can request in a first correspondence is credit or removal of an image or legal property.

It is someone trying to scam you.

Photographers invest a large portion of money and time in they gear and knowledge to make photos which we use everyday. Simply they would like to return invested or part of it.
I know this is black hat forum, but there is no need to for such rude words...

Back to the topic, give them some credit or simple remove image in question and bye another one from stock for cheap price.

Don't post it online then. It's plain simple, you don't get anything in return for posting it online and if you do get something in return then there's your payment. And on OP's case his image was actually labeled for reuse.

The email came from the owner of the image. I think he didn't see the credit we've given...

To be sure, I've contacted a lawyer who hopefully can give me a conclusive answer. I sure hope you all are right, but I certainly want to avoid going to court.

Too much BS in this thread...
It really depends where your client is located. Since you quote a sum in Euro and this 'image-copyright' is very common in Germany, you might better consult a lawyer. Although the sum of 1300 is a bit high, the might be entitled to a lower sum for usage of their image.
I'm not sure about the law in other countries (as does no one that posted before in this thread, so unlike them, I only comment on what I know

Not really, the cost of taking this guy to court for some stupid image would be way more than I'm sure he's asking for.

I don't know how it works in your country but in mine if you press charges and go to court, the guilty part is the one who pays everything.
