Selling Gary Halbert on eBay

I had an interesting experience recently on eBay. My question is more about the legals of what happened here.

A few years back I purchased a cassette tape collection of a Gary Halbert's Marketing seminar. It was 24 tapes, legitimately produced. Great seminar too!

A few weeks ago I decided to sell the product on eBay, since I have a copy of it on my iPod. (Yeah I know you aren't supposed to that )

After about 3 days I got an email from eBay telling me that Mr Halbert's estate had seen the listing and that it had be be removed because 'piracy' is illegal!

I would fully understand if I was selling a pirated copy! eBay removed the listing and told me to contact Mr Halbert's estate if I had a problem. The contact email they gave me was not legit.

I would have appreciated a direct email from the estate to ask their questions but no such luck. Has anyone ever seem this happen with eBay before? Seems to me asking a few question would have been nice. I had several interested parties too!

I had an issue recently on ebay where I was selling a database that I have put together over some time. There was another member there that claimed I stole the db and they were the true owners. This person had never seen my db or my site, but just KNEW it was theirs. They sent ebay an email claiming they had rights to my product. As it turns out, ebay simply deletes the item and tells you to deal with the person who reported you. They may ask the person who reported the item to file a VERO claim, but most times they do not. (this is only a paper that says to the best of their knowledge they own rights and you don't) You can file a counterclaim by writing the trust and safety department and requesting it, but it usually takes 3 or 4 days to get a reply, then another 3 or 4 days to actually get the file. My advice would be to take pictures of the tapes and put a disclaimer at the beginning and end of the auction stating that this is an original copy and that no others will be sold after this one. You can list quite a few times before ebay will take any action against your account other than the listing being removed. Although this can hurt your powerseller status if you have it. Hope this helps you out a bit and good luck with the auction.

Thanks for that advice. I was worried I would lose my account for re-listing the item. I guess eBay is trying to protect themselves, but they do need a better system. I am not interested in selling something pirated on eBay. Seems far too risky, but I imagine it happens all the time.

I agree with the above.

It seems that when dealing in media information it is pretty cut and dried that if you put a disclaimer or announcement in the beginning and ending that you are the legal owner of the product eBay pretty much leaves it alone. Just make it a notice to eBay that you are the lawful owner and as stated that it is the original copy.

You should get along fine.

Yeah, that happened to me once too. I just resold a ton of scripts that i had bought off ebay from a seller and then I get a nice little email claiming I am way out of line and his lawyer is going to contact me. He was obviously full of shit but I wasn't making money on that garbage anyway.

I relisted the package yesterday as they had suggested above. It sold in about 2 hours
