ThePirateBay is back online!

Again, just reporting what I've read. I assume that since the company is "based" in the US, US laws apply.

Define "illicit" and by what countries' laws, and the comparison isn't really between Sweden vs. America, but rather "safest country" to "least safest country", and also the storage method and what data is stored. Example, the torrents might be stored on the Server's hard drives, but what about the connections? And if they are stored on the hard drives, for how long does the company keep them. And will a company voluntarily expose it's User's data to law enforcement scrutiny or will they demand a court order, and in some cases do they have a legal team that will challenge a court order if the law and/or legal precedent is not perfectly clear.

Some companies (Hidemyass) will roll over immediately and put extra effort into giving law enforcement whatever data it wants, upon demand, while other companys (Private Internet Access) at least claim that none of their User-specific data is stored on the hard drive, but instead is only kept in volatile memory, and only for as long as the Server needs it to actually do it's job.

I think you are just mad that he lied when he said he wouldn't come in your mouth, but then he did it anyways, and then laughed about it.

LOL! Seriously I wonder if this would of worked for Stealth Genie?

One can demand a court order in America and challenge it in court, and TPB is illegal in almost every country for the criminal copyright infringement it engages in.

You make that statement as if it's black letter law. It's not.
Who copyrighted the torrents that the site stores? A: No one.
What copyright data exists on the Servers. A: None.

Also, provide examples of the case law from "almost every country" that proves your assertion that "almost every country" has adopted the US position that torrents that point to what might be copyright data are the same as the copyright data itself, and have been consistently ruling in either civil or criminal courts against defendants charged with these kinds of offenses.

By your reasoning, a link from your website to a site that happens to have child porn on it (in addition to other material that may not be illegal) is the same thing as actually having porn on your website, since the link to the site that has the illegal child porn can be used to acquire the illegal child porn.

And THAT is the heart of the argument the MPAA/RIAA asserts: that torrent files are links to what might be copyright material, and since a person can use the torrent file to illegally access copyright material, the Servers that hosts those torrent files are doing the same thing as if they actually had the copyright material on their Servers. But not all torrents link to copyright material, and torrents are not the same as copyright material, and even if they are, it is a violation of a Web Site Owner's right to free speech to require them to scrub every 1 and 0 from their servers that might be used by a criminal to link to and/or acquire illegal material.

But it all "feels" the same to the dim-witted nitwits, and that's who the MPAA and RIAA are able to successfully persuade.

What if they applied that standard to BHW? Any link to any copyright material would be illegal, and could justify a police raid to kick down the doors to the Server room, seize the assets, shut-down the website and open any and all forum owners AND staff to both criminal and civil prosecution.

So, it would be a good idea for you supposed, so-called (but we all know you're not really) "black hat internet marketers" to consider exactly where you'd like the line drawn between "copyright infringement" and "free speech", because the more broadly some of you nitwits would like it to be drawn on someone else (because you are blind, stupid and phallus-gobbling sycophants of the MPAA and RIAA), the more likely it is that someday YOU are put in jail, charged with a crime or sued in criminal court for copyright infringement.

Again, what are you talking about? You can run an Nginx server is whatever the fuck country you want. You know that right...?

What can I say ... glad they're back.

Why do you persist in posting in so many threads (particularly this one) when so much of what you post is "Captain Obvious" level generalizations that add little to nothing, what little substance there is, is factually wrong, or (as in this case) completely nonsensical.

"One can demand a court order in America and challenge it in court..."
WTF does this even mean? Challenge what in court? The court order they demanded? Someone else can challenge a court order in court?

"TPB is illegal in almost every country for the criminal copyright infringement it engages in"

Yeah, you said that already, and I responded that you should 1) define "illegal" (last time you used the word "illicit"), 2) name the countries, and 3) show the case laws and legal precedents that are regularly rendered by the courts in order to make your assertion a matter of "Black Letter Law". Do you even know what "Black Letter Law" is?

Maybe you think it's the legal system that regulates the color of fonts?

Or do you just repeatedly post meaningless blather in random threads about topics you don't know anything about, having put any effort into thinking about, haven't put any effort into constructing posts that are even minimally comprehensible?

Are you going to post some new kind of nonsense next time, or are you going to repeat the same nonsensical blather you've already posted twice before, for a 3rd time? The 1st time it was merely annoying, but the more often you post this nonsense, it becomes increasingly entertaining.

So the continual shut down of sites such as TPB as well as torrent sites keep changing their tld isn't enough for you to understand that it is illegal in all those countries?

Again, what are you talking about? You can run an Nginx server is whatever the f**k country you want. You know that right...?

What countries laws govern the Nginx Servers? Where the company (in this case torrent website owner) is headquartered, or where the Server is physically located? What makes "Nginx" so special? Does Nginx guarantee that they will not voluntarily release information regarding their clients who lease the Servers, or data regarding their client's visitors? What IS Nginx's privacy policy regarding the privacy and protection of their clients, and their client's visitors? Do you have a copy? Have you read it? What's your point anyways?

You assert The Pirate Bay has it's data on Nginx Servers, as if that is some kind of magic mojo that means something, only you don't bother to tell us what it means. Is it a secret shield? A magical protection? Is it like the Lord of the Rings "One Ring to Unite Them All" that Golum wants so badly? Is it a religious talisman? Something left behind by the Knights Templar that will give it's owner Unlimited Protection Against Hostile Government Intrusion, with a 2d6+3 modifier vs. Spells of Illumination?

Please do explain to us all what makes these Magical Servers of Nginx so special, and how you've come to have this knowledge.

If it was as simple as all that, there wouldn't be any torrent filesharing sites at all right now, would there? You've ignored all my not-all-that-difficult questions, I think primarily because you can't answer any of them, and here we are at the end result of your reasoning. Here's your brilliant thought process:

1) Lots of torrent sites have been shut down.
2) That's because they are all illegal.
3) Since they are all illegal, all torrent sites will be shut down.

4) All torrent sites have been shut down. (like KAT, Demonoid, etc..., etc...)

#4 is what's missing in your feeble reasoning. I should note to the audience that this is classic. Because it "makes sense" to him, it MAKES SENSE. And, in his mind, if it doesn't MAKE SENSE to you, it's because you are stupid.

Stupid, can't you see that P2P filesharing is illegal, torrents are the same as copyright material, and anyone that does it is a criminal? We don't NEED to think about the actual laws themselves, the countries where those laws are created, and enforced, the results of court cases or the definition of "black letter law", why we don't need ANY of that complicated "thinking stuff", we've got THIS GUY telling us all "how things are" using his patented "common sense" method of "figuring stuff out".

You should patent this method. It's really brand new. No one else has ever been able to figure complicated stuff using this simple-minded method before. I'm sure there's a way to make a lot of money from it. Maybe you can go to work for the MPAA or RIAA. They'd just LOVE your "Simple-Minded Method to Figuring Complicated Stuff Out". You could write an e-book, and some self-help videos, maybe even do a website.

No one is going after P2P or Torrent sites just for the technology they use, they are going after them for the copyrighted material they infringe.

The whole purpose of the major torrent sites is to help in the sharing of copyrighted material, and benefit from the sharing of it.

Are you on drugs? Do you know what Nginx is? Its web server software, an alternative to Apache.

Whatever the fuck country the Nginx is running in...? The same for Apache or any other web server software.

What makes "Nginx" so special? Does Nginx guarantee that they will not voluntarily release information regarding their clients who lease the Servers, or data regarding their client's visitors?

What the fuck? Did you read the Wikipedia page? Why would the Nginx company have anything to do with TPD's data? The webmaster just downloads the software and runs it.

You assert The Pirate Bay has it's data on Nginx Servers, as if that is some kind of magic mojo that means something, only you don't bother to tell us what it means.
I didn't say anything like that. You said they haven't done anything different, but they have. They are using Nginx instead of Apache.

You're really stupid and should read Wikipedia pages before sharing them as if you're some master Googler.

Really? Define the word "infringe" and explain how hosting torrent "infringes" anything.

You don't really know, or understand anything, do you? Also, what is this whacky comment "technology that they use"? What does that mean? What "technology" to "they" use, and who are "they".

Truthfully, I think you are s**t-faced drunk and blindly stabbing at characters on the keyboard.

What the actual fuck is this kid smoking and where do I get some?

And so what? Conversation here is centered on the level of safety for users of The Pirate Bay. You mentioned Nginx Servers like it meant something, but you can't tell us what it means. You never made a point. You drooled-out something about servers, software, alternative to Apache, and fail to connect any of that to the discussion about The Pirate Bay, but (lol) you ARE certain I'm the dumb one.

And so what? What does that have to do with anything. He might scratch his nuts with his left hand now too, as if that means anything significant. Maybe my mistake was I should have ignored your meaningless statement as meaningless? Btw, posting a link to wikipedia is a courtesy extended to people that want to do their own research in order to learn. It wasn't really posted for you, as you obviously aren't interested. Isn't there some weed you could be smoking, somewhere? Some sizzurp you could be making?

I am still certain because I made my point earlier. You said nothing changed and I said yes it has, they moved to Nginx. It was a joke because everyone is moving to Nginx but that obviously flew over your inflated head.
