Personally i would not take if for free.
1) your customers will not trust you when one day they type the word shop instead of click a link or book mark
2) i am sure shop.com will probably sue you
3) you promote the fuck out of your site only to have people end up at the real shop.com or the real shop.com have your site taken and take all your traffic
4) if Google catch wind of it which i am sure they will when the real shop.com report it to them then good by google traffic
5) the real shop.co will end up getting half your emails
sounds like a waste to time effort and money to me

if you can be sued for using a similar logo to some one else the clearly shows you intended to copy it or affilate yourself with them you can be sued for misleading people with an h that is not really an h.

But actually OP. That domain you have has a pretty good useability. You can make any shitty webshop appear as a multi-million dollar operation. Could be worse.
