but you think that i need redirect 301 of the older to the new?

Each update is different so I don't know how 301 stand up to this one. You can try and see, failing that you will have to rebuild your rank.

if i use the content of the old domain in one new domain without use any 301 redirect or text link, ie, nothing indicating to this new site... google can see this like a black hat?

Well it could be construed as duplicate content, but unless the owner of the content I.e. you, report you they are not going daft over it, and the old site should be gone soon enough, bearing in mind the spider will try and crawl it etc

He might as well 301 the penalised domain to a new domain, make some money, and then kill it after the penalty transfers before starting over.

I actually took a punishment, but the site still has 70k daily of visits, which had before 200k... so I cant give it 100% ...
