E-whoring was not, and is not the same thing as blackmailing. If any real blackmailing occurred it means the OP went above and beyond the classic technique. As discussed before, most blackhat techniques can be argued to involve some degree of misrepresentation by somebody contentious enough to push it as being such, the question is how much is too much. So a fake webcam girl profile is no-no, but a fake sexy girl Facebook account is okay? Is a slick looking WP site that is run by one guy, misrepresenting the scale of the company? And so on.

What EW has turned into is a higher risk form of blackhat, in that it may invite more aggressve litigation, from parties who will paint the tactic in the darkest terms possible. The OP should have lowered their exposure using the technique, instead of (apparently) using the most easily traceable funnel he could put together.
