someone submitted a counter-notification on me

so i have a very successful video that has made me pretty good money. unfortunately, someone re-uploaded it and cut into my views heavily. i submitted a copyright and today i got a counter-notification. it is my understanding that my only option is to sue, or he gets the video back.

is this right? because if so, i clearly am not going to go through the trouble. so i am thinking this is the first time i will get really dirty and do something like click bombing him. thoughts on how to handle this, as well as tips?

Just because you created a video does not mean you own any rights to it that are worth protecting in the eye of the law. He probably knows that and uses the law to his advantage ... That happens. Just move on and learn.

no it is definitely mine and my own creation. so he has no rights to use it.

however, i noticed he sent me an email a couple days ago asking me to remove the claim because it would be his third strike and he would lose his account which was his sole source of income. so i guess when i didnt reply he did the counter out of desperation. every single video he has uploaded is stolen from other people i noticed.

Submit a dupe video takedown notice. Ive taken down a number of videos that way without issue.

Everyone can submit counter-notification, even if I had such videos with VEVO music. Do you think Sony will just release the videos because there may be a suit?

Depends what country you're in. In the UK, if you create a piece of work then you retain 100% ownership of it unless there's some sort of license agreement in place.


One of my videos earns me a tidy packet each month on YouTube so much so that there are many people watching it and then mimicking what's in it to try and earn some money. To be honest, I'm cool with that since as it stands when people search for this particular kind of video mines is the first result on YouTube and also on Google.

However, some degenerate piece of shit decided to copy the video exactly without even being smart enough to add in some filler at the start of end of the video. Regardless, the offending video has been removed and no counter claim was made but there's no way I'd allow someone to use my video for their own gain. This video in particular took a long time to plan out and solve a particular problem that has blighted thousands of users.

OP, it might sound harsh but who cares if his account is deleted? People need to learn to stand on their own to feet rather than ripping off the work of others. Hell, if you allow that kind of thing you may as well go and rip off the HP franchise with a slight reworking and then reap the rewards (and the inevitable jail time).
