Strange problem when moving penalized site to new domain

I'm experiencing a strange issue when moving my penalized site to a new domain. All of my pages are being indexed with exception to the site's root page, the index page. I have removed the old site from the index with a request and a noindex meta tag, nothing is showing up when I do a search for "site:domain.com". I have checked to make sure that none of my content has been copied by using copyscape and yet it is not being indexed. I have heard that even without a 301 redirect a penalty can follow. Has anyone else experienced this? Any ideas on what I can do? Maybe have all my content re-written? Maybe there is a sandbox for my index page?
 
Can you fix the penalty? In my experience it's easier to remove a penalty than to start all over. Google in the past few months are approving reconsideration requests faster than before and without as much work involved.
 
I actually went that route first. I got hit with about 300k shitty backlinks. I tried to disavow what I could then sent a reconsideration request. Google told me they lifted the penalty and 3 weeks later nothing had changed. I just decided to start over. I wasn't too attached to the domain.
 
Follow these steps to see if they can help you resolve the issue

- Add the new site to a new webmaster tools account.
- Use the fetch as google tool to fetch the homepage of the site.

If the fetch is successful, then just be patient. The page will eventually get indexed. If the fetch isn't successful, the error message that will be displayed should be enough to help you determine the reason why the page has not been indexed.

You can also submit the page to Google using the same tool after the fetch for faster indexing, although I don't recommend this for certain reasons.
 
I realized I had a link in my robots file to the old site's sitemap. Hopefully that didn't link the 2 sites up. Stupid mistake on my part. I changed that and then ran the fetch tool. The page is now indexed.
 
My site's not even penalized and the homepage has been deindexed. It's short on content but I've never seen that happen before. It's even set up in WMT with a sitemap.
 
The same happened with one of my new sites. My old site wasn't penalized either, just didn't rank and the homepage of the new site just won't index (the old site was removed from the index completely).

Lately I'm not seeing rhyme and reason to Google's indexation.
