Question regarding off shore hosting

Right now Netflix is trying to take down one of my sites. If I switch the name servers to some offshore name servers and the actual domain is still registered to Hostwinds is it still safe to keep using it and ignore there requests?

I phoned Netflix they said they will give me few warnings then may pursue serious legal action.

are your domain protected by whois?

They have your personal information?

If they dont, you can host it on offshore and ignore them.

Yes I got privacy protection. They may end up just getting my first and last name.

Depends how serious they are. If they really want to take your site down, you should be registered with an offshore registrar and use a domain name that isn't controlled by Verisign, or a US based registry. You basically want to have nothing that connects you to the US if you have infringing content.

That only really becomes important if they ever do actually take legal action. Are you responding to their DMCA requests and taking down content when they request it?

Okay I will try to find an offshore that I can just transfer my domain + hosting to. Hard to find one that accepts payments other then paypal.

I'm not sure exactly how it works since it doesn't apply in my country, but I think you have to take action immediately, and then the uploader has to appeal it. When you submit a DMCA request you swear under penalty of perjury that you are the owner of the work.

What they do is ignore the site and go after the site owner. If you are in the USA, you may end up like kim dotcom....fighting an uphill legal battle....

That is, if they're really interested in you....the legal threats may be empty, in which case you can just host offshore.

If you are going to do anything and I mean anything in the entertainment category that breaks copyrights
then you need to sign up for an offshore hosting company to start. And it would not hurt to sign up under
a false name.
