Is this legal? Can I do this?

I have a couple legal/domain related questions that I'm hoping some of you guys can help me with.

1) I have a domain that I want to buy but I'm not sure if it's legal to use. Let's say there's a website called australianchocolateforumDOTcom and I register australianchocolateforumDOTcomDOTau (top level country domain) will I get in trouble for this? I'm pretty sure that it's ok because it's a generic term, but I wanted to be sure.

2) If a person has a website called australianchocolateDOTcom and on that site they have a forum which is called "Australian Chocolate Forum", is it legal to buy australianchocolateforumDOTcom so I can (without admitting, obviously) piggy back on the exact-match searches for that domain? They are using the name for their forum but they don't have the exact domain, and I can't find any trademarks related to the name "Australian Chocolate Forum". And again, I was thinking that it would be ok because of its generic nature but I wanted to be sure.


Obviously these are not the real domain names, but I have my eye on a few domains that go along one of these two scenarios and I'm hoping it's legal for me to pursue. Any and all input is much appreciated.
 
You should be original and make a authority site of your own, instead of trying to attach yourself to someone else success.
 
yeah its 100% legal if you're sure its not a trademark

Totally Agree.

To OP: It's not a must to have a EMD to rank . Even with a different domain you can rank you keyword (if you know how). So i think it will better to build your own brand.
 
You should be original and make a authority site of your own, instead of trying to attach yourself to someone else success.

I appreciate your honesty but G is making it harder and harder to rank so there's nothing wrong with having an edge. Plus they are generic terms, so branding doesn't come into play as much. The domain itself is the brand. But thanks for your input I appreciate it.
 
Thanks for the reply. I know it's not necessary to have an EMD, but I am having a lot of difficulty ranking my forums without having some sort of advantage. Admittedly this is because I'm not an seo expert but I still think it will work. Generic terms seem to be used a lot in the US with EMDs and people seem to enjoy easier ranking with them, particularly a forum keyword which will continually bring new members.
