Legal Issues with downloading themes?

Doubt it seriously. Jeez buy the theme if you are that concerned about it.
I've gotten Cease and Desist letters from attorneys before, but they never did anything thank goodness (silly attorneys wanted to shut me down when I was promoting their client's product - people get confused sometimes).
Anyway, I say if you haven't been legally challenged, you haven't tried hard enough ~

First thing that ran through my mind was "that has got to be as close to a BHW slogan as you can get".

I don't think you would get in trouble for downloading. They might write a bad review of your site, but they won't go to too much trouble. If you were selling or distributing their theme, you might get in trouble however.

Almost all WP themes are issued under the creative common license. If it uses WP functions it automatically falls into this license.
The CSS and images may be proprietary, but the bones are open source on almost every WP theme (or plugin) out there. I even have little script that re-brands themes and plug-ins to turn them into your branded product. Great for Pad submissions,
Generally,no one really cares, but you could get into a bind if someone had a hardon for you.

I agree - this is an issue that theme developers have been looking at for a while, there is no RELIABLE method for seeing if a blog has in fact bought the theme, 99% of themes are GPL and how are they to know if you have bought without spending a lot of time and effort into code-protection or tracking. Even if they did go for this tactic you would be able to see it in their code (the license type means that it cannot be encoded).
Maybe in the future there will be a way of tracking effectively but for now, theme developers have to work into their budget that most that have the theme, have not bought.
