What do you think he was doing to stay in that #2 spot? If the spamming didn't work to kick him out of it, maybe figuring out what he was doing and doing some of that would.

I don't get why people say "if you do negative SEO to someone else's site, they will do it back to yours". No they won't. First of all, there is no way they will know who hit them with negative SEO. What are they gonna do, unleash a giant negative campaign on every damn website that is targeting their keywords?
Second, some people won't even realize it was neg SEO in the first place that knocked them off. They may just attribute it to a Google change or something they did on their own.
As for me, I think it's a grey area with this stuff. If you have a pretty high quality site and focus on building quality links, and some asshole comes along with a shitty EMD 1-page Wordpress blog and outranks you, then I say blast his site to nowhere. However, I personally wouldn't do it to some guy who looks like he's trying to build up a quality site with a lot of good content and who is actually putting in the work.

it was a EMD (or pretty close) and a PR4 link. He's actually gone now, so it did work - the only problem is that it wasa NYE event, so I was a week late.

To make it a bit clearer, the links I am dealing with are PR 7.
They are not competitors just negative press that has come up to the first page. Problems that have been resolved but linger still. So I am seeking a way to deal with them by pushing them off the first page. So no real bad karma.

Well typically it is pretty clear who hit you, if you are 5th for a keyword it probably wasnt 1-4, you are 5 so that leaves 7,8,9 or 10. If #7 is wikipedia, it wasnt them. So that leaves just 3 more, yeah it is not all that hard to figure out and yeah I am pretty sure people around here fight fire with fire when it happens.
I wont confirm nor deny I retaliated against a competitor who was #1 in my niche after knocking me out of #1 and now he is gone from SERPS....

I could add that half the time it doesn't even work, and when it does it can normally be fixed.
The only benefit I can see is to screw someone just before black Friday or something like that and while they are temporarily down take the benefit of a relative rise if they were a little ahead of you in SERPs
I've had sites recover from offiste over op (which is what neg SEO attempts to trigger - so it's the same - only self inflicted) Panda and Penguin. I've had sites benefit from attempted neg SEO.
The self righteous, bullshitting, "just as black hat as everyone else only 1/10th as effective" twats at SEOMOZ actually invited people to spam them as hard as they liked (and many people did) multiple Xrumer servers, SB's the works...all that happened was some of the long tails dipped then recovered to even higher positions than before.
Spending time on negSEO that could go on your own site is.... well... a waste of time in the long run, and yes - someone who knows how to do it better than you might return the favour. I know I would - but that's the only time I'd use neg - as retaliation.

I don't really need to say this because everyone else has, but exactly what they said. Why not work on ranking your own damn site instead of being a hater. If they are successful, it is most likely because they worked hard to be successful. Why don't you work hard and do the same thing.

Yeah I see your point. But how do you know it wasn't some guy on the 2nd or 3rd page that happened to try and hit everyone on page 1 with neg SEO so that he could move up? Or maybe if you're at #5, one of the guys in the top 1-4 spots hit your site because they saw you moving up the ranks and didn't want to lose their position in the future? People can draw pretty good conclusions as to who hit them, but at the end of the day, there is nothing that gives concrete evidence as to who it was.
