LOL... I really liked your guts. But the only reason for buying this domain is to do the business in their name. I am not a very creative person myself but when it comes to such things it is better to go a little slow. now you have got a lot of feedbacks so atleast change the strategy you are working on.
You can not get in to the water and compete with the fish.
flippa has put alot of efforts and money creating the "name". They will surely let you go if you just register the domain. How do you expect to start the same service and in the same name. do you think people will misstype the domain, flippa.com to flippa.im and start selling the sites?
where will you get the traffic from?
even if you go ahead with the same service and start getting popular then do you think they will not come behind you? It is a business.
Can you sell the VW cars with their brand name?

probably to tell them hey we gonna be pertners cox if not it really does not make sense in any way think straight be smart and let that shit go am sure you have your private information on the domain whois including emails address and numb.....you might get visitors in BLACK

It was too much bullshit in this thread for me to read the whole thing, so someone else may have pointed this out already. "Flippa" is trademarked for a very limited range of services. As long as whatever you use the site for is outside these services and basically cannot by any "idiot in a hurry" be confused with these services, you should be fine.

Also a C&D can't be issued for holding a domain. It's what you use the domain for that can result in a C&D.

If you want to check out the flippa trademarks, look up trademark reg # 3777396 and 3777394 in the US. They may also have trademarked it in other jurisdictions, but you can usually safely ignore those since 1) they will usually be for the same categories as in the US (there is an international standard for categorization of trademarks) and 2) most other jurisdictions don't have the same retarded rules regarding compensatory damages claim as the US.

And he tried to sell the domain to the trademark owner.
It is a matter of when, not if.
Perhaps we should set up a pool *cough* poll on it.
 
The question would be whether he actually sells domains under that trademark. There is a difference between selling soft drinks marked LocaCola and trying to sell LocaCola.com to Coca-Cola.

The second he starts using Flippa.com for any service matching these categories, though, he would have a problem:

Sorry re the links. You can look Flippa up yourself on http://tess2.uspto.gov Select "basic word mark". There are two registrations in different service categories.

If I were him, I would use the domain for some hard core porn. Very clearly not a violation of a trademark, and yet somehow I think maybe Flippa would reconsider and put an offer in after all...

Do enlighten me as to what I am not correct about. I may hold an LL M, but intellectual property is not my field of expertise, and I am always anxious to learn from an expert.

As for "3", it was included in my post "for entertainment purposes only" and should not be "tried at home".
 
Put a fake flippa homepage image, and put content locker. Rank the site.

He could have kept the domain, he chose to try a case study. Nothing wrong with that. Trying to excuse his actions is not smart.
 
Just to illustrate, OP could register the trademark Flippa in the US. As long as the trademark is not in the same categories, as far as I know ithe registration would be accepted. Selling a shoe branded as "Flippa" for example, would not be a problem.
