Twitter's lawsuit against TweetAttacks VOLUNTARILY DISMISSED

Twitter apparently had trouble serving notice of the lawsuit to Jayson (creator of TweetAttacks) in the Philippines. This could have good implications for those non-US companies who create and sell bots that target US-based social media sites. An excerpt from the court filing:

NOTICE IS HEREBY GIVEN that Plaintiff Twitter, Inc. (?Plaintiff?), hereby voluntarily dismisses Defendants JL4 Web Solutions (?JL4?) and Jayson Yanuaria from the above-captioned action without prejudice pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(i). Defendants JL4 and Yanuaria have not yet been served in this action and have not served either an answer or a motion for summary judgment. Plaintiff requests that the Court vacate the hearing scheduledfor July 13, 2012 on Plaintiff?s motion for alternative service on Defendants JL4 and Yanuaria.

Note: the dismissal is without prejudice, which means that Twitter reserves the right to sue J4L again if it wishes to.

According to US law you can't serve a legal entity on foreign soil, anyhow. They have no jurisdiction.

There was no Jurisdiction. Tweetattacks can still come back if Jason wants to bring it back and He should bring it back.

Think of it this way, He was creating more revenue for Twitter if you look at the business side. Twitter brags about the amount of new followers they get daily, but only us BlackHatters know that a lot of those new users on Twitter are bots. So, in one essence it does help them on the marketing edge. Same thing goes for Facebook.

Twitter should've saved that money they spent on the lawyers to scare Jason and put it back into their cheap networks and servers that always go offline.

There was really no lawsuit since the fact that He made the software and cannot control how someone else uses it, and He did put in the terms and condition of the purchase and use of the software.

If you made a gun, and someone bought it from you to commit a crime, are you the manufacturer of that gun guilty of the crime that the customer did? "NO."
