The CAN-SPAM Act does prohibit emailing to scraped lists, as well as dictionary sending. It also prohibits sending of adult-related content or links to non-opt-in lists.
However, it does not expressedly prohibit the mailing to leads that are not opt-ins.

This means that you are allowed to prospect via email marketing. When done legally, this is usually done through list rentals via lead brokers.
