If you're involved in applications, or methods, that go against Facebook's TOS I want to give you a heads up.

A bit of background information. I was recently contacted by one of Facebook's lawyers, Joe Cutler. He had some stuff to discuss with me regarding alleged spamming, virus creation, software/scripts and phishing on Facebook. Apparently Facebook have been monitoring me since December 2010, although he said 2 years, which is odd because the dates don't match up. So moving on.

Straight off the bat I was asked if I'm "Stella Artios" from BHW. Clearly they are active on this forum (*Waves* to Joe Sullivan). I don't hide my identity. Foolish on my part, maybe, but what's done is done. A lesson learnt.

He then went on to discuss why he needs to speaking to me. He attempted to bribe me and wanted information on networks I've used. I've used a lot of networks in the past, and for some reason there was one in particular they wanted information on. They also wanted information on all publishers I'd worked with, anyone I JV with, and anyone that works under me. Basically said I have to come clean and be totally honest and open. Admit to everything :L

In return for this information he told me it's possible that Facebook would be lenient with me.

I asked what crimes I had committed, or what Facebook "say" they have on me. So he went on to explain and also said Facebook are looking to get Scotland Yard involved. Apparently my case was packaged and ready to be sent off to law enforcement if I didn't comply.

To sort of cap things off Joe Cutler was attempting extortion, but choosing his words carefully. If I didn't hand over the information I'm basically f**ked.

I'm not a grass, I told him this. If they want to press charges for alleged crimes than I'll deal with that. I shouldn't need to grass people up and hand over information to save my bacon. That's how snitches work. Not to mention I would lose a lot of friends and a lot of valuable contacts. Not worth it. You play the game, you get hit by the ball. Shit happens.

The funny thing is even if I handed over information they could never guarantee 100% protection and they couldn't stop anything relating to criminal charges by law enforcement. He said that.

So, this is a warning, or a heads up. Be careful who you speak to because there are snitches about that would have taken the bait. And keep in mind that it can take a long time for Facebook, or any other site to build up a case against you. This has happened to several people that I know of.

I'm still waiting to see if they were bluffing or not. I don't like the shady games they are playing in order to get information from people. Scare tactics. I think it's only fair that people are aware of it.

It's really important where are you from.If you haven't broken any Law in your country,then you're good.For example,in my country,only Email Spamming is illegal.Anything that breaks a website TOS is just an Internet matter.

Even if so,we all know how much money facebook haves,and what lawyers they have aswell.Be carefull.

Maybe so but right now in UK they have ditched protecting the rights of UK people who are being chased by the USA and the FBI

Honestly, I think they were trying to scare you into revealing more info. I would think that with a company that big, that if they had the goods on you, that you wouldn't be capable of making that post - that you'd already be in a jail awaiting trial - and THEN they'd be seeing what sh1t drops as you sweat it in the pen.
 
Best route to take is to cease any violations you are allegedly doing. If you have been committing crimes on facebook then its best to nuke your hard drive clean and reinstall. If charges are filed they will raid your house seize assets that they think were involved in any crimes. That would most likely be your computer. If you nuke your hard drive and your computer gets seized then there will be no evidence on your computer to convict you of the crimes. From that point on facebook needs to prove you are guilty by other means of evidence.

When respond to the lawyers always play it stupid. "I don't know what you are talking about." "Please send me a list of specific violations you think I have committed." Keep it simple and don't talk too much. Remember, those e-mails could be used against you in court to convict you.

Also the laywer is bullshitting you when he says he will let you off easy. No papers have been served, you haven't spoke with your lawyer, no judge is assigned to the case. That lawyer could say x then once it goes to trial he will throw the book at you.

None the less, my advice is to go clean, stop spamming facebook if that's what you are doing and get a lawyer if you get served. Once the lawyers start contacting you, its time to throw in the towel and move on to something else. Jail is not worth it.

Exactly what I was thinking.

I'd upload the phone conversations, but then that would be breaking the law.

I have TrueCrypt on all computers anyway with different 35 character passwords on each. Them breaking into these computers would be impossible. But, a DBAN might be worth it.

in all honesty I think they bluffing. If the case was that serious I would have thought they would have had me arrested and let the police get it out of me.

Hopefully this means that without a confession, they don't have jack shit on you. But you shouldn't have told him your not a grass. You're admitting you're guilty without directly saying it.

Keep slayin em stella artois... Sell all your electronics on ebay, and buy new. End all VPS subscriptions, and change your affiliate details etc etc

Basically stop what your at (or do it smarter) and start putting up alot of barriers, don't play ball and just roll over, make the shitheads work for their money.
 
Don't respond give them anything.
I suggest to ask BHW to delete your posts, encrypt your drive with truecrypt (use hidden OS for plausbile deniability).
From now on use an offshore corp, since obviously you are doing volume.

oh... read you are already have truecrypt :) Use the plausible denibility option since UK will ask you to give up password.
Also, get a different screenname.
