Content "How to" access illegal content - It is illegal?

Hello,

If a website provides instructions of how you can access illegal content , this website is illegal? In your website you dont host illegal content but you give instructions to your visitors how they can access it, it is still illegal? Any thoughts or experience on this matter?

Don't think so, as long as you put a disclaimer or something like that. For informational purposes only..
 
It depends on the type of illegal activity and where you live.
 
If you link to a downlaod, hsoted on a filehostingsite its illega. if you just say "you can google for a.nice.movie.dvdrip.xvid-ind +rapidshare to find files" you should be fine. bit better talk to a laywer in your city...
 
if you're not actually hosting the content then I don't think you're liable.

But if it host in other website, not yours you won't have problems, you just give them the link of a download. Because, in this case 98% of the website are illegal
 
I would say it depends on how you display the information and local laws.

If I setup a site called Howto-Kill-your-wife.com and plainly explain the toxins that can be used and how the crime scene can be staged, I would think they will find a way to get me busted.

If I setup a site called wife-killers-caught.com and start to explain how "some" people did it and what mistakes they made it becomes a whole different story.
Even if I put on a guide that shows exactly what can be traced and not and where those bad guys bought it I wouldn't run into problems.

The above is taking things to the extreme a bit but still, it is the intention that counts.

If you search for a guide to WEP cracking you will soon find guides intended for personal use on your own network that will instruct you, in detail, how to crack your own wireless network. Not to be used for illegal purposes of course. :rolleyes:

My country doesn't respect its citizens enough to not extradite them on petty charges to foreign countries...

Also, I wouldn't exactly call myself an expert in the field of killing RL people, I am sorry if I left that impression. :o

I did find out however that the site actually exists, I didn't check the domains before posting.
Could use some improvement though. :)
With this url I would go the humorous way and invent 10.000 nails in her coffin or something like that I think. Or go educational...
Then again, I am a newbie so what do I know. :D
 
Helping in any way is illegal but you won't get arrested unless your site is well known and has been seized more than 1 time ( if you buy another domain for it and that domain has also been seized )
 
describing something is very different than linking to it...

I'm not a lawyer, but I think this would fall under "facilitating a crime"
