Even if they were recorded by amateurs you can still get sued... unlikely but still (for copyright).

On the other side, getting sued for uploading videos, I haven't heard for such case.
 
Yeah you can get sued, but not everyone will bother checking to see if their videos where used. But there are copyright features implemented in youtube so you might want to look at that.
 
Of course you will sued.. Just be careful and read a YouTube guidelines before uploading..
 
Yes, the copyright test you have to take when you are caught infringing someone else's copyright is very detailed about it... You're not even safe if you record yourself singing a cover, just to give you a better idea of how ridiculously far we've gotten with this shit...

But the real question is... Does one really care about it? It vastly depends where you're located. Also if SOPA passes what most ppl ignore as a useless threat might become a little more serious. For now the actual "real-world" risk is close to 0 even for Stateside folks, unless you do something really really stupid, but we'll see what happens in the next few months.

If you re-upload files to kill time from some internet cafe from behind a vpn, they won't get you...

If you do it for a profit, chances are you're promoting an affiliate link and given the right motivation, you can bet they can track you, courtesy of your cpa network.

As I wrote -AT THE MOMENT- I see very thin chances of some copyright holding entity to actively seek a case against some small fish, unless you do something retarded.

But things might take take an unexpected turn in the few months. Not certainly for the best and, oh... not just for the law (not-so)abiding US citizen... Search on google what happened very recently to Spain ;)
