You'll be alright. They might make you pay some money back, but other than that, the shit is civil. The feds will always give you a buzz after so many complaints, especially if you are accepting credit cards.​

Been hit by them a few times and their little brothers the ftc. Roll with it, learn from it and keep making that money.​

They usually send you a "Cease and desist order", did you not get one?​

You probably already mentioned that, but Im too damn tired to read all this fuckin blackhat lawyer talk from the guys.

Hopefully you told the customers they were reps and not the real deal.​

Anyway lawyers can cause more problems on things like this than not having one.​

If you got a mailbox through UPS store they sign for you therefore you wouldnt have to reveal your real name/addy

Never been my experience. Maybe the people working at your UPS store don't care about their jobs or something.

So I don't see how you would be able to get a UPS mailbox without showing legal name and proper identification.
 
I think you would be better off renting a empty space or paying off the delivery people. Maybe a mail forwarding service?
 
When I read these comments, I realize one thing. None of you have any REAL advice for this guy. None of you have sold replicas or dealt with big headed lawyers threatening frivolous lawsuits.

If you get a lawyer you are wasting your time and money. Take it from someone who was sued by True Religion for over a year for 100k.

Whatever you do always answer the cease and desist letters. Its your proof that you acknowledge that you are caught. Just because your caught does not mean your guilty. At this point in time they know nothing of your business. Only that they believe your making quite a bit of profits from the sale of their goods.

Never admit to selling replicas intentionally. When they ask you how much you sold, be careful they will hold this number against you for the duration of your case.

Remember when I said always answer the cease and desist letter? If you don't answer this letter it gives them leverage when asking the judge for a court order to gain access to your personal information like e-mail, merchant account records, and shipping statements.

You DON'T want them to gain access to this information. They will see how much you sold and get a hard on!

You can handle this without a lawyer. Most lawyers don't even know how to handle these cases. A trademark lawyer is too expensive and useless to you as a single individual.

Don't listen to these people haven't been through it. I've been in the business for 7 years and been through two lawsuit attempts.

At the end of the day my result was: CASE DISMISSED!

If I were you I would try to reach some sort of an agreement with the company so that they will drop the charges, work for them for free for 5 ears instead of jail time.

UPDATE: I received a call from my lawyer today saying the company is going settle for the amount we sent back but I'm not allowed to discuss the amount but it's way less than 700k. Going take awhile to get paperwork done but looks like I'm going to dodge a bullet mostly. I have to sign a paper saying if they catch me again they can rape me pretty much. As of now I'm not looking at any criminal charges but nothing is in writing yet.

All you were doing was raising a little money to feed your family and a big company like that come down on you like a ton of bricks.

Look at the end of the day why build a "business" where you are scared shitless of stuff like this every day? Hardly peace of mind is it? Wasn't the whole point to enjoy life and time?

Go legit..maybe lower profits but it's leveragable and you are not going to wake up one day and poof all gone.

i got a letter from a company when i was selling their stuff on ebay back in march. i freaked out as they were demanding something like 20k, all the products, my suppliers, etc. they told me to lawyer up and contact them, etc. i resisted the urge to reply at all and here it is november and i never heard from them again. are you sure they are not bluffing?
 
To be honest if... you where selling these items and making the customer feel like they are getting the real deal... I hope they kick you in the a$s a bit.

I bought a 3k watch that turned out to be a replaca and took me like 3 months to track the POS down... fly to his crappy appartment and get my money back plus airfare myself with a very large friend of mine, never called the cops ;)
