Amazon Associates Closed in California

I love California, but seriously do not understand the government sometimes.

but I guess this can be said for pretty much every state.

Was wondering if anyone figured out an easy way around this? Does just opening an LLC in another state clear you, or does where you are domiciled have something to do with it? I suppose if you run all of your income for that site or those sites through the LLC, then you should be fine right? Maybe you would need the company and also a PO Box or something? Anyone? Bueller?

Anyway, a quick look on G and you'll find plenty of agents in Nevada who will provide you with the whole shebang - an address (with forwarding), the necessary papers, pretty much everything except your signature to set up an LLC there. Bonus is the tax situation in Nevada is very pro-business - IIRC it's only like $100/year to have such a business (but if you hire one of these agents, they'll add a couple/few hundred on top of that).

I am in no way an expert so please take this with a grain of salt until you talk to these agents AND your CPA, but I think this is pretty legit. Delaware is the other popular state to do this in.

The question that needs to be answered (and your CPA will help here) is if the LLC being a Nevada entity is enough. It seems like Amazon, if they see a Nevada address, shouldn't red flag you and you should be good. But CA is notoriously prickly about taxes and where a business operates and where you live, etc. My gut feeling is that the business gets the money from Amazon and you get the money from the business so you should be covered, but CA could have ways to work around that to try to stop you.

I'd say if it can work, then it's clearly worth the trouble if you make even a few hundred a month from Amazon. It might be smart to open a bank account in Nevada also just to be on the safe side. Sounds like a great excuse for a trip to Las Vegas to me!!!

In fact, if y'all are too lazy and want some help, I'd be willing to put in some real research and talk to some experts, but that would cost you (the experts don't come free, neither does my time). Reply to me here if anyone wants to work on this together (don't have PM capability yet).
