Another Stolen Content Complaint... My response?

I had another user complain about having her video stolen... This time the lady said she was contacting DMCA as well as Youtube. She also posted comments on the video and my channel talking shit. So I went and looked at the terms of use more closely, and found out they actually have to be a Copyright holder (which you have to actually file for with the government), and that youtube makes you jump through hoops to even make an official complaint. If they don't have a copyright you can file a counter-notice.

I deleted the video since I think the only views were me and her after several days, so it wasn't a traffic source... but I had loads of fun with my response. I plan to respond similarly to any future complaints... without deleting the video. I could just ignore them but it is more fun to mess with people


"I removed the video, however in the future we will require official proof of copyright ownership for any alleged infringing content before the removal process can be implemented.

Should YouTube chose to remove any alleged infringing content, upon failure to provide the requested information within a time period of 48 hours, a counter-notice will be filed with their Copyright Agent and the content will be restored within 10-14 days as per the YouTube Terms of Use which were agreed to upon registration.

At that point, should you chose to publicly express any further slandering remarks in regards to us or any affiliated parties, you will receive contact from our legal team with a summons to appear in court at a venue of our choosing in regards to a defamation of character lawsuit.

I obviously highly doubt she filed a copyright for her crappy 30 second dating tips video so I am curious what grounds she has legally? YouTube is in the public domain. Are you sure you're a law student?

Unless you get a letter from a lawyer I wouldn't worry about it. I think if youtube was contacted they might suspend your account but other than that , this happens all the time. Big whoopie.

Without official proof you should be safe.
If there is a problem, they have to contact YouTube, they'll ban your account and all is off.

In the US the act of creating something grants the creator the copyright immediately, no government filing is required.

I'm not a lawyer but you might need one if much $$ is involved.

Okay, after reading a helpful document provided by youtube from the United States Copyright Office I can agree you are correct, ever since the laws changed... before I was even born if I'm not mistaken... It's not moral, you're right, but neither is committing fraud against affiliate networks and advertisers or stealing from software developers...

There was no money involved in this case, my video had 4 views after a few days and hers had like 60...

On the plus side, I had a $117 sale from an upsell today (or I'm assuming, considering I got nearly 4 times my normal commission), and two other $26 sales, through an excellent method involving one thing I have done with the (quite powerful, really) program responsible for all this... so it is worth the hassle of having people complain...

If any of my accounts get banned, it will be for having so many affiliate links in my videos before any of this. I will delete the videos if they ask from now on if I don't end up hearing from youtube. If youtube never does anything to my accounts, if they are doing especially well, I am leaving them...

I guess this is a learning experience for her. She should have made sure her information was clearly stated in the video so that she could get credit and then be happy when someone steals her video because it will only make her more popular.
