DMCA protection for domain

I am trying to protect my sites from DMCA takedown.
I am non US citizen.
My domain is currently under Godaddy and cloudflare.
Hosting in Contabo - A german hosting but they have serers in US

I understand that DMCA can also result of suspending or domain.

1. whats the point of ofshore hosting if they can do the google DMCA take down or suspend your domain?
2. should I move both of my hosting (which is in europe but they have US servers) to an offshore DMCA ignored?
3. Is there any risk of having the domain under my real name?

godaddy is a piece of trash for any kind of website, even worse when we're talking about something like your case

my domain is under godaddy and my hosting is contabo - a german hosting
 
There is some risk having your domain under your real name. But if you are doing something illegal, you need to have a plan of when to get out. The longer you stick around and the larger your product is, the greater the risk.

Cloudflare will pass your IP to the DMCA requester and then the DMCA request will be made to contabo who will kick you out in seconds.

DMCA requests to GoDaddy will get you out real fast too.

If you are doing illegal things, it's all about trackers, word of mouth and places of link collections like fmhy.net. So google DMCA takedown does nothing to you. Regarding domain, it's like a pointer, they get banned all the time, you just buy a new one and update it in all the trackers, media or whatever.

I do kubernetes, can certainly pump a project up if needed. Write me if interested.

If you want to help the guy do it for free (and preferably here for everyone to see), otherwise you might get eyed and it'd be a shame as not many people offer such good replies :)

regardless I found some interesting post on reddit on someone trying to take down a site that was on godaddy and also contabo.

Go daddy just passed your information forwards in this case

But Godaddy can defiantely lock the domain and freeze your account if they want.

I don't have the power to ban anyone (I'm just a member like you), only the mods can ban....

And yeah, I know that new users don't know the rules, that's why I cautioned him, especially since he gave an expert reply so I want him to stay safe as we need more people like him :)

Anyway, to try and answer your questions (although I'm not expert on these matters, I'll only say what I know / have heard):

1. offshore hosting means hosting that's not in USA, so basically, every hosting that's not in USA is considered offshore.

What you probably mean / want is hosting that doesn't abide by Google (and other US companies / government)'s law, and such hosters are very rare, I actually don't know of any hoster that shows the middle finger to USA (which is good, because USA is not God to dictate everyone what to do), but you can try using hosters like Njal.al, Alexhost, Shinjiru, etc...

There was a list of hosters that are supposedly not bending over to USA, UK and EU's wills (the 3 most mafia organizations that are responsible for most evils on this planet), but I can't find that list at the moment. But I'll keep searching and if I find it I'll post it here. In the meantime you can search too, 2 heads and 4 hands are better than 1 :p

Be advised, however, that these hosters can steal your domain at any time, without warning, for any reason they want. It's actually happened to some forum members (with Njal.al I think), so it's still not safe. But at least they're (supposedly) not complying with DMCA takedowns, so they're safe in that regard if that's your concern...

2. your call, of course. But know that no hoster is safe (at least I haven't found one that's safe), there are risks involved with each hosting either in terms of safety, or performance, or whatever...

If you're running a black hat / grey hat / shady business you're probably better off switching to "offshore" hosters, but you have to find one that doesn't steal your site when it starts making money :D

3. I think no domain is safe, if someone with money and influence wants to find who owns a domain name they'll be able to in many ways. The only way to completely hide your identity online is to never be online (and even that's not enough because many big companies have their own satellites nowadays and are connected to CCTV cameras and can find you even if you bury yourself 100 km beneath the Earth).

Personally, I've never used my real name when I registered domain names and never had troubles with this. But I'm also pretty sure that nobody has bothered to look up who's behind my sites, otherwise they would have found out within hours :p

Anyway, I don't think you should stress about it. Just use a fake name if you're just running normal sites like most of us. And if you run shady / illegal sites and the government wants to come after you.... well... you won't be able to hide anywhere regardless, so real name or not you'll still be found. So, don't stress about it :)
