.com protection - Any advice welcome

Hi, I run a renewable energy business and one of our companies is under threat from a chancer of the legal variety. Our lawyers are dealing with it but he has already caused problems and I want to ensure that the .com is protected from him. Is there an ISP that anyone can reccomend? I looked at NJALLA but read some poor reviews and am unsure as to how much protection it affords from our regular ISP. Thanks in advance

I usually try to copyright the domain word like for example in a domain like wombatheaven.com I try to copyright "wombatheaven", sure it costs some but if it is a good name it is worth it. Remember there is different classes, so copyright it in a class that is not copyrighted and relates somewhat to your intended business.

Thanks. I own the TM and patents but this is a Lawyer claiming also to have rights. He's looking for money to go away. Its not the first time but i'm determined not to give him anything but want to protect the domain as I host it with a simple provider in the same country. So i'm thinking of taking it 'offshore' if there is such a thing

If you have TM in the country then politely state: "I refer you to the reply given in Arkell and Pressdram"

Apologies, I should have been clearer. I run a corporation and am one of many shareolders constituting 90% of the ownership. A minority shareholder who is also a Director sold the IP and TM to someone without telling any of the other shareholders or officers of the business. This is something we will eventually win and we have 2 law firms engaged to that end. In the meantime he has set up a website promoting himself as the rightful owner and is threatening to try and take the .com ....I want to see if there is a safe haven I can steer the domain to until our lawyers have dealt with the issue which could take some time.

Ahh completely different scenario. You cannot hide the domain. You can take the website offshore but the domain is still vulnerable to challenges.

If he takes you to UDRP he will have the trademark and may win. You may be able to use bad faith defence.

You may have to start thinking about rebranding which would be a lot cheaper and quicker.

Thanks for taking the time. We should win and need to keep on as we have invested a lot in the brand over many years, If he goes normal legal and not sneaky legal then we will ultimately prevail.

You will win anyways just be patient don't touch anything . He is just digging his own grave . Never stop an enemy when he is making a mistake! He will just grow settlement/reimbursement amount by committing even more fraud

Thanks, Just galling that we have had to engage lawyers in Canada and the UK to deal with someone who is ultimately just a sophisticated thief. Ho hum...
