Due to some issues related to trademarks, I had to set up a new website with a new domain name to replace the old website. My plan is to back up new data to the website, then delete the old website.
The reason I don't redirect 301 is because the old site doesn't have much to store, other than the data content in front of the old port.
According to my thinking, after removing the old website or actively de-indexing it on Google, the content of the old website after being moved to the new website will be indexed and will be under the authority of the new website. Go to the old website again and of course do not violate ABC algorithms related to content.

Your thinking is correct.

Just delete the website, request content removal from Google, then post the content on a new site and you should be good.

Still, doing 301 redirects is the more surefire way of doing this and unless you are visibly benefiting from the trademarked domain, you should be fine from legal point of view.

So unless you are already on the radar, then just do the 301 redirect, the trademarked domain will eventually get removed from index and you are good.

If the old website has something authority (backlinks) that's helping it rank, it won't be a very good idea to ignore it without doing a 301 redirect. Doing 301 redirect would help you retain some positions. Unless you're legally being prevented from doing that, I'll highly recommend you do it.
