Adsense Foreigner Owned USA LLC - Taxes

was searching on the internet, but didn`t find the answer. Hopefully we all are here, on bhw
Hope somebody had similar situation, so:

I am not US citizen running US LLC. Now it`s time to withdraw money from Adsense, where problem occurs, Adsense asks

Tax form questions

1. To help find the appropriate tax form, please answer the questions below as they relate to the account holder for this account. Are you a US citizen, US resident alien (e.g. Green Card holder), US corporation or US partnership?
   1. Yes - I do have US corporation (limited liabilty corporation, LLC)
2. After that asks for US address - that I provide, etc.
3. Part 3: Certification
   Under penalties of perjury, I certify that:
   • The number shown on this form is my correct taxpayer identification number, and
   • I am not subject to backup withholding because: (a) I am exempt from backup withholding, or (b) I have not been notified by the Internal Revenue Service (IRS) that I am subject to backup withholding as a result of a failure to report all interest or dividends, or (c) the IRS has notified me that I am no longer subject to backup withholding, and
   • I am a U.S. Citizen or other U.S. person.
   • The FATCA code(s) entered on this form (if any) indicating that I am exempt from FATCA reporting is correct
   The Internal Revenue Service does not require your consent to any provision of this document other than the certifications required to avoid backup withholding.
   Signature of US person
   -> it looks like G does not treat foreigner owned US LLC?

or foreign owned US LLC fill tax form in other way? Maybe somebody had similar situation?

An LLC is a disregarded entity, unless you decide to file otherwise, so you are not a US citizen for tax purposes with Adsense.

You need to fill in the W8-BEN form instead - see here https://support.google.com/adsense/answer/4646662?hl=en-GB

Question 1)

I suppose I need to create a business adsense account and then connect my business bank account (that I got through my US LLC or Canadian LP/LLP) with the new adsense account. Will I still be able to take advantage of the tax treaty since I'm a (tax) resident of an Asian country (I'm a citizen of a European country though)? I've read online that I could potentially fill out a w8ben E form despite my company then being in the US or in Canada. I've also read about the w9 form but I don't see any fields for possible tax treaties on that form.

Question 1.5)

If this is not possible through a business adsense account, could I just make a personal adsense account instead and fill out a w8ben there?

Question 2)

Is it possible nowadays to connect either wise or payoneer to google adsense? I've seen some people say it's not possible, others say it is.

Hi,

Yes, you can fill in business entity data only when you create it. As far as I know, it cannot be easily changed later (maybe it could be done with the help of Google support, but I had to delete the previous one and create it from the very beginning).

If you create a business account for your company registered, for example, in the US or Canada, it concerns your company, not yourself. I mean, Google pays your company, not a physical person in this case (this is not advice since I am not a lawyer or CPA, so consult your lawyer or accountant). So it shoudl matter only between Google and your company. How you withdraw money later - it`s your solution. I created everything according to https://support.google.com/adsense/answer/4646662?hl=en-GB.
Sorry, I don`t remember everything. I created an account about 2 years ago. If you have websites for monetization, try to reach out to the AdSense team with questions. In my experience, they might be quite helpful sometimes.

1.5) As far as I know, if you create a personal account, it will be your location.


2) I have a bank account; I think it depends on the country of the company where you create an AdSense account. For example, Wise has the option of account number creation, so I assume you can use it. You won`t know unless you try it. I didn't have experience with Payoneer.

I'm in the sam situation with the LLC, if you found the the solution can you briefly tell me the options you choose? W8 or W9 and do you have any withholdings from Adsense? Currently with the options I have Adsense is withholding 30%.

When I verified my AdSense for an LLC, I wasn`t asked for passport, only company documents.
Physycally my company is paid, not me.

I won`t help you with tax laws, sorry, ask your lawyer/ accountant

On my ID verification, it's asks for US Passport or green card or so... How's that possible? It doesn't even give me option for address outside of US, as the authorized representative.

I have a similar situation, if you are not a US resident but you have an LLC created there and you select the W-9 (which is for entities like the LLC or others and persons resident in the US) I thought it was ok but not because the LLC not being a resident and being a sole proprietorship you must use the W8BEN since the W9 makes you look to the IRS like you must pay taxes in the US (which the sole proprietorship LLC does not), I ask you, did you have problems with the IRS during these years for using the W9 instead of the W8BEN? Or is it really ok if you put one or the other as long as they approve it?

Hi, yes, but it was a long time ago, since than as far as I know it might have changed
