LOL so ehworing is legal for women but not for men? So if my girlfriend hits the go button on clad and hits the go button on my autoresponder then I am OK? :rolleyes:
it is legal for men also if you are not pretending to be anybody else than you are and after they signed up with your site, you give them what they want (so if you're try to convince a woman or if you're gay, you give them a camshow)
and if your gf hit the go button its ok, but you have to use her own pics for your ad and after the guyz signed up, she has to give something in return...it's pretty simple...so the "classic" way of ewhoring which you're doin is illegal...you get caught?...i don't think so...

There ya go 1. it's technically identity theft since you don't have permission to use the girls pics in that manner. It is spamming because you're not actually going through with the offer that you're posting. And Spamming is illegal, although it is a grey line issue on CL. And if you read my entire post I clearly state that although ewhoring isn't like robbing a bank or anything but the thread's title is: "is ewhorin illegal in us?"

And the federal justice system says, technically that yes identity fraud is illegal. They also say the same thing to spamming. Which you're doing both w/ ewhoring.

Even though the 'man' isn't paying attention to ewhoring doesn't take away the fact that it's identity theft and spamming. So therefore illegal.

So to answer the thread's question, yes technically its illegal although you probably won't have police busting through your door any time soon. But it hypothetically could land you some time if you're indeed convicted of identity fraud. I never said that you'll beyond a doubt get arrested for it, but it still don't take away the fact that if CL really wanted to, they could find the people you're using photo's of and have them push charges on you and get ya busted.

Gotta love when people get their google law degree. The actions are illegal but they couldnt prosecute you if you have any sense, and if you are hitting enough inboxes you have to know something about the net. Send ur emails thru a proxxy and they arent going to trace it back to you in the first place. What are they gonna pull the gmail account that i have 5000 other emails forwarded to that were made in god knows what country. If i was a doing e-whoring in person maybe they would have a better shot at getting a conviction but its asinine to believe that anyone is gonna have any actions taken against them personally except for people like the guy im quoting googling fraud and finding some generic way to tie it to what you are doing, but would lack the resources and knowledge to tie it to a certain entity, such as the person making the money.

If you are worried about pulling a random girls pic off of the net...just buy content. Do a search on google for adult content. You can also get content from some of the adult affiliate programs.

Make sure that the 'terms' are showing on any credit card submit pages.

Do those two things and you have no worries about identity theft or wire fraud.
 
We need to start giving these guys the answer 'yes' to everything is illegal, so that if anything happens no one can say 'BHW' told me so.

You start to wonder if that's why these guys open threads, just so they don't feel liable for anything. Come on you know what you're doing dude.

With that said, selling Burnt CDs is illegal, but you only get in trouble if you turn yourself into a factory.
 
I just made three search queries in the US Code for "e-whoring," "ewhoring" and "camshow." Nothing. I'm sure misrepresentation of one's identity is in many Acts, but I don't see anything relating to "online misrepresentation" or anything. Maybe someone else can give it a shot. I did not use THOMAS.
 
Also, another point i'd like to make

if you get the girls pic off a social networking site 'TECHNICALLY' its property of that site, not of the girl who posted it there

I would say its more a civil matter. Just dont promise something you dont deliver. Then again there is a difference between ILLEGAL and UNLAWFUL. Most things are illegal but most things are not unlawful. Practically only theft and violence is unlawful. Illegal just means its contrary to a corporate government policy statute, that doesnt make it immoral, but they will come after you anyway. Logic and morals rarely matter in court.

As long as its something like, "I sometimes use this other site too and you can join for free", you will be ok.

I make so much money "ewhoring" its insane. =)
