How do they upload old movies without getting blocked?

I saw plenty of old movies with a lot of views.

Just seems that youtube doesn't care?

having it removed is almost like getting a ticket for speeding you could get caught or you could get lucky for YT not finding your video, i have had videos be removed for the smallest reasons and i have seen porn videos with nudity being on YT for years .

The 2 main reasons for bans are:

- spam complaints
- copyright complaints

When too many people complain that they didn't get what you promised them AND flag you for that, the spam ban kicks into action.

The copyright one is different. When you have (old) movies up from movie-companies or copyright-holders who aren't "screening" YT on a regular basis you get away with it.

Only thing is, some of these comps are bitching about everything. Even 40 year old movies.

So when you want to get into this business just keep statistics on the companies that file the most copyright claims and stay away from them.
There plenty more out there that don't care apparently.

I wanted to ask one question about this also... I might be wrong... but wasnt there a rule of some copyrights expiring? Does anyone know about this law anything? Like if i get some REALLY OLD movies from 1920-1940s. Can i upload the whole thing legally to youtube??? Im sure if it would be legal, i would hit few 10ks of views with them, no matter how old they are .

there are tons of movies that are now in the public domain.
You just have to search for them.

Oh yeah, in the states, pretty much *anything* published by the Federal Government is automatically in the public domain.

There are a couple of exceptions, but that still means that there is a helluva lot of 'free' content you can legally use.

It gets really messy, when you have content that is now out of copyright in some jurisdictions, and not in others. Technically you can do as you please with it in those jurisdictions, but on the intarwebs it is open to the whole planet right (except for China sometimes).

I would add a big fat **This movie is now in the public domain**, or put that in an email to YouTube.

I was selling some images in the public domain on eBay a while ago, and ran into a problem with 'the competition' flagging my stuff as copyright violation. I tried emailing eBay to let them know, but once your auction is suspended, they really drag their feet. Much easier to just put a sign in the auction stating that the images were in the public domain.

Here's another thought, you can create a derivative work, and own the copyright to that.

Example:: Take a cookery book that is now out of copyright. Add public domain photos from Flickr and maybe some commentary on each recipe or something.

Technically, you own the copyright to *that* derivative work, and nobody can copy it willy nilly without your permission.

hehe, thanks for the info. Do you know if there is a list for all the work which is public domain at the moment?

Btw, im from EU also, but i think we need to follow US rules anyways. So if its good there, it should be ok here.

I find that YT place their google ads on any of my videos that are copyrighted, the minute I change the audio the Ads disappear.
