Experian sued over ********************************.com ads

to be honest, i'm not defending or accusing anybody or anyone of anything, just tryiing to show how easy it is to be sucked into something....it doesn't mean your stupid if you don't miss the super small fine print.

It's one thing if the person, after reading and understanding the terms of the free credit report offer, calls to cancel within the 7 day period and gets the runaround and their card is still billed. That is fraudulant and will get you thrown in jail...ask Steve Warshak, former owner of the company that makes Enzyte (those annoying Smiling Bob ads). But if the person was just too lazy to read the terms that they were agreeing to, then how is it a scam?

People like to blame others for their failures instead of looking in the mirror. If you sign a real life on paper contract without reading it, no matter how small the print, you are still bound to the terms of that agreement.

How is this any different?
 
I was a mortgage lender for about 20 years....the bottom line is Experian does not
need the negative publicity and will settle any and all issues.

actually i do, not when paying cash, but when using CC or some type of service, i always check fineprint.

there is almost fine print on most stuff today.

for example here in sweden they are selling this super fast mobile internet that is "24mb/s* "

and ofcourse the fineprint *24mb/s is the highest speed, and the speed varies to 0.1mb/s to 24mb/s depending on location.. and you know what that mean.
 
This is currently on the front page of their site and if I remember correctly something is mentioned in the commercials (but it could be another free credit report ad) about a membership

I compare this to those that smoke then get cancer and sue the cigg. company.
They claim they didn't know the consequence.
Bull*hit..read the fine print.
 
I signed up for a credit report through experian a while back. I read the fine print and just like any other trial offer, I knew that if I didnt cancel I would be charged. I canceled before the trial was over and did not get charged. Ive canceled many trial offers and in return, did not get charged. Maybe I should stop canceling them and just start suing them. lol. Hey there's my first $100,000 a day method.

I held up the line at the grocery store for an hour today when I went to pay with my credit card demanding to see the fine print.

Now when you say that is stupid, think about it, you trust your grocery store, people trust experian.

I agree, it's very easy to get sucked into something and most people probably don't read the fine print. I just don't think they have the right to come back and say they were scammed because they agreed to or signed up for something without taking the time to read that fine print.

I m sending you my affiliate link . All you have to do is go through the terms and conditions and apply for the trial offer. Just try to cancel that offer before trial finishes. Is that OK...

P.s :
Nobody receive that phone calls when they call their support to cancel the trial offer. It call gets connected also they have to wait 20-25 mins just to speak an agent.

I said that if they are giving people the runaround and still charging their card even after they try to cancel, then that is fraudulant and land them in a lot of trouble, sometimes even jail. Again, googld the name Steve Warshak and see what doing that sort of thing got him.

That is a totally different issue than someone crying scam because they didn't read the terms of the offer and ended up getting charged.
 
Unfortunately, the U.S. is the litigation capital of the world. Anything can be challenged and won in a court of law. Doctors and cig companies and car companies have lost lawsuits before. Wanna go up against that system?

The FTC is giving you your fine print now.

How did Experian violate their trust if the terms were on the site? It states that they will be billed after 7 days unless they cancel. This isn't buried 5 pages deep on the website, it's pretty clear these are the terms when they sign up. Because they failed to read it, Experian scammed them?

I just don't see the logic...
 
What a joke.

These people who are clearly to stupid and/or lazy to read the terms are so quick to cry deception and file a lawsuit. These are the same people who go to a real estate closing without a lawyer and pay over MSRP for their cars. No amount of disclosure on your site (even if you are Experian) can fix stupid. Even their TV commercials disclose the offer is not "free" for Christsake.

I find it quite funny that we're here on a blackhat site, and people are saying anything is *remotely* wrong with what Experian does with their ********************************.com offer. There's people here that do some crazy shit just to make a buck, and these guys play it straight up and get bitched at & sued over it? It is not hard to read the TOS - and why would you not when you're giving your credit card to them for a "FREE" offer?

Of course they're not going to have $14.95/month in big red letters. Yes, they hide it- of course they do, it's a marketing thing. This whole thing is ridiculous if you ask me.

If they have to pay $75.95 every month for the next year then 2.95 wasn't all they had to pay now was it? (therefore the statement in BIG letters about $2.95 was a false statement...ie they lied)

Companies put a LIE in BIG LETTERS and then counteract it with the truth in the small letters


It deceptive and wrong....either your telling the truth or not there is no middle ground....and sadly to say most all US marketing is false advertising and lying....

Its brilliant marketing really, doesn't make it right. I would not fall for it, but I know a lot that will.

When the TOS are included all the way at the bottom of the page in very small print its fair to argue that it's fraud/misrepresentation - it's misleading plain and simple with a website has "FREE" in its name and charges people. Only exception is if customers saw a big text warning at top of page saying they would be charged for using this service, but if its at the bottom of the TOS its obvious fraud. Its almost like a clever con.
