Hey guys, i've heard that cold emailing is legal if you send emails which comply with GDPR and CAN-SPAM. I've heard that such emails should be B2B , not B2C , correct?

Do we have people in this forum who are sending cold emails legally? Would be very interested to get your ideas how you make cold emailing 100% legal. Thanks and let me know!

If you want to be "100% legal " send only to those who opted in for that.

The real problem is, younger people are not familiar with the word spam.

There's no such thing as cold emails. It's just a term invented by gluten intolerant/vegan people.

Spam is spam, and it's illegal. B2B is legal, but the way you are asking, I doubt you can be on the legal side.

I dare you to register a .ltd tomorrow, and blast 30 000 000 B2B emails.

I'm willing to bet 3 unvaccinated people's lives that you will most certainly get in trouble.

"that you will most certainly get in trouble." - what do you mean by this?

In the USA spam is defined as "unsolicited commercial email". There is no law in the USA that prohibits spam and there is no opt-in requirement. So yes, you can legally "cold email" AKA spam. Just make sure you comply with the simple rules laid out in the CAN-SPAM act:
  1. Do not use false or misleading header information
  2. Do not use deceptive subject lines
  3. Identify the message as an advertisement
  4. Inform recipients of where you are located
  5. Inform recipients of how to opt-out of receiving future messages
  6. Honor opt-out requests as promptly as possible
  7. Monitor messages that are sent on your behalf

Cold Email term is illegal itself.
You can play something out of the box to get them opted for you though.!

The most legal way that you'll get is to send emails and newsletters only to those who give you their consent for that. Another thing is that in reality, this happens really rarely, and even some big companies are scrapping emails that they didn't collect legally. But, if you would like to make sure you're doing everything right, this would be the only safe approach.

All cold emailing is legal as long as it complies with the empty rules of privacy.

In the mail, none of the information of the resenctor should be made clear, not asking for information until he accesses the dialog and not making clear the Method with which the @ of the mail was obtained.

That is why Netflix can send you advertising to the mail legally without having any membership with that company.

This are only things you need when you do that cold mailing but do follow the warmup process too..

Good luck :)

Cold email is legal in the USA but almost alway violates terms and conditions with your email provider. If you are going to send cold emails do it strategically with a proper warm up.
