How does this guy keep avoiding copyright claims?

I'm trying to enter this niche because it seems fun and the guy is making pretty solid money.

But everytime I try to recap a movie, I get copyright claimed when I upload the movie. Here are things I've tried:
1. Make the clips shorter(2-3 seconds maximum)
2. Change the opacity/brightness of the clips
3. Horizontal flip the video.

I keep getting copyright claimed regardless and basically the whole video I make is gone because youtube doesn't tell me which part is copyrighted. This guy has clips that are like 4-5 seconds long and he doesn't get claimed.

He's a more experienced youtuber, so he must have some kind of knowledge or tricks that he's using. Does anyone have any ideas?

You getting copywright on video clips or audio? My guess is clips.

If I should make a guess, I would say it's the same as video reactions, you get copyright strike first but it should fall under fair use so you could get them to remove the copyright if you provide enough unique content as he is doing. But it's just my guess, try to talk to a lawyer.

However, I've been providing reaction videos to Hip-Hop related songs for going on 2 years now.
This is not the same niche, but I assume the same logic may apply.

I dmed him but that would be a huge secret leaked and more competition for him. He didn’t respond the first time maybe I’ll ask a second time lol. Clips are copyrighted. Audio is my own.

Yes.
Compared to some other niches, the amount I get paid per click / engagement is dramatically lower.
but we do still get paid.

I have a few videos which I filed for a fair use appeal on them, and they was declined.
Those videos are not eligible to be monetized.

However, once a human reviews your video, (I think they just skim through it personally) and decides you did use a fair amount of your own content.
You're often eligible for the appeal to be successful, and your video monetized again.

Alot of creators do this process before even publishing their videos.
This is a process you won't have the ability to experience for awhile tho if ur just starting out. Because it requires minimum of 100,000 Subscribers for a direct line of support.

I have a question that, is it ok if you file a counter under the fair usage act and they don't approve ? because only court can consider fair use thing, not by youtube
I already have 1 strike from youtube but my content is transform and I think it's under fair use. I want to send them email to notice about this problem and ask them whether they will remove the strike ? If they don't will my channel got ban from youtube ?

Spin video in and out every 2 minutes
No sound
Add sound agin but use a sound application.
Add sub tittle on.
Make picture zoom in more then the original
Account must be 2016 or older .

Try that.

There 100% a way just find it.

Zooming in definitely has effect
No sound definitely has effect
Spining the whole video in out and twist effect works.
Using subtitles from new sound from a voice application works.
Add it all from an old account more then 2016 helps.

Just to correct/clarify when you fight a copyright claim, it is NOT YouTube who decide [if it's fair use/etc] it is the person/persons who made the claim.

They get to decide themselves if they are right or not... hmm

Of course if it's obviously Fair Use and they decide in their favour anyway, you would likely easily win in court and can claim damages. But realistically who takes these cases to court.

I think if you are a bigger channel, if you have a strongly worded email for your claim and maybe mention that your video obviously meets all three/four requirements to be fair usage. And highlight the money penalty for false claims and that you will take it further if they rule in their own favour... unless they can give you some evidence as to why they believe [in spite of all the evidence] that your use falls outside of fair use

I really don't know how a small youtuber can have the clout or time to do this effectively

It is crazy to have the judge in your appeal - be the other side [the people who made the claim] - but that is what it is
