Paypal legal question - 180 days hold

I'm just thinking about something, wondering.

Let's say Paypal bans you on the 10th of January and holds your money for 180 days (say $10k).

You contact them with a message trying to get them to review your account, to see that your account never had any chargebacks and is in perfect standing, asking them to consider allowing you to withdraw at least some of the money before the 180 day deadline.

They get back to you and basically say: "No, you can't have the money. We're holding it for 180 days from the moment of the last payment your received, which was on the 16th of January"

Okay, now, Paypal is a stickler for the rules right? I can login to my account and clearly see that the last payment I received is on the 10th of January, which is also the date when I received the email that my PP account is perma banned. And I have their reply telling me that the money is frozen for 180 days from the last payment I received, and they say that date is the 16th of January.

Wait just a second. So what they're telling me is that they're holding the money for 186 days, not 180 days. Isn't the deal 180 days? Isn't this breaking their own rule? Wait just a second Mr Terms of Agreement, this is not the agreement.

Does this open them to legal action? I have what I consider undeniable proof here.


p.s I believe the reason their system counts the last payment 6 days later than the correct date is because I had an eCheck payment in progress which I received a few days before I got banned, and it was pending clearance at the time of ban. And that payment was cancelled and refunded about 6 days after the ban.

BUT, that payment was received days before the ban, so technically, according to their support words, and according to what can be seen if I login to my account, they're wrong on this, and they're holding my money for 186 days now.

Lawsuit? Harvey Specter? Suits?
 
If you want to take on PayPal, by all means. But I would not let 6 days get the best of you. Be lucky they are not holding it for longer... Im still waiting on $17k to get unfrozen.

I don't want to. But you lay down the rule to me, and I accept it because you have all the power, but then you break your own rule. Just because you broke it a little bit, doesn't make it nothing. Just because you raped a little bit, killed a little bit, stole a little, you still broke the rules of agreement!!!

It just rubs me the wrong way. But forget about me, how does it rub the law?!

Ps I had seen a service here that helps you unfreeze 180 days stuff you can check that. You’ll burn a lot in legal expenses with no guarantee you’ll get a favourable ruling.

I don't really need to do anything to get the money out before the 180 days. This was my fully legit and verified Paypal account, and the money was earned through honest and legal means. I'll get the money out in 180 days.

Oh wait, I have to wait 186 days! It's supposed to be 180 days, but now I have to wait 186 days because of a technicality. Should be illegal...

Same here. Mine was also legit and verified. If your account gets suspended, it doesn't mean you broke the law. They just recently updated their policy so now it's terminating accounts. Either way, best of luck!
 
They're not a bank and don't abide by FTC regulations so they are within their rights (which you agreed to when doing business with them) to hold your funds at their discretion. Additionally the representation of one employee doesn't give you basis for a lawsuit. On what grounds would you sue?

What is your loss? 6 days worth of bank interest at 2% on 10k? $4.5 of economic loss?

I'm cool as a cucumber until the 31st of the month. 1st of the month I'm coming for my money, but whether I get it back or not we will never be friends again, you can't be trusted.

It's money, it's serious, every second counts.

Anyway, I'm just a little upset because they said 180 days, and it's like counting the days to get out of prison, and then it becomes 186 days. That's not fair.

You have to prove damages in civil cases. Sure PayPal loses goodwill and you won't want to be their customer in the future but there's no real legal course of action you can take (assuming you don't want to throw money away on a frivolous suit)--which is what I think your original post was asking. Not much you can do besides deprive PayPal of your future business.
 
I've seen that before. But that would be just empty threats coming from me. I don't like making empty threats. And I don't really want to antagonize Paypal, I just want the situation to be resolved Correctly. 180 days wait is Correct, 186 days wait is not so much.
Whining here won't help you, doing things "correctly" probably won't either. If you really want your money you gotta do everything you can.

P.S: Apparently this person tried that too and got his money before 180 days
