Legal problem in UK - please HELP

Hello,

i have big problem in UK with company called Kelkoo. I've build a website to sell clothing and started advertising with them. I've spent 250Ł and didn't have a single sale, so i've sent e-mail to their manager with information that i want to cancel my account.

After 2 weeks they did cancel and obviously they charged another 2 weeks for ppc, which i didn't want. Also i found that most visitors was bots and they didn't do anything about it. I've informed them many times that i will pay 250Ł because it was part of contract, even if it was bot visitors.

Now after few months some collection debt company wants over 600Ł (which i don't have) and they are threating with legal actions.I've looked closely on contract and i found 3 major things:

1) They are charging more for ppc than in contract, about 25% more. So they trying to ruin me.
2) They didn't stopped my account when i wanted to. In contract there is 1 month cancelling period, but not a single word about paying for ppc in that period.
3) Most visitiors are bots (i have prove)

Can somebody help me? What to do? Should i be afraid? I'm from Czech Republic.

Just ignore them, they cant send collection agency for sure. Even if they sent, you clearly mentioned your budget and even you have proof that they are charging way more.

So you have nothing to worry about it. And are they charged you for ppc in adwords? I dont think in adwords most of them are bots.

In contract we had 400Ł monthly budget, but i've sent them proposal for stopping when it was around 250Ł.

Now i got email that in contract prices are without VAT, which i maybe overlooked, i will look on it tomorrow. But if the amounts were right, still they can charge me?

Nope this is their price comparator website, not google adwords.

Send them a letter with all of the information in it. Include everything possible - copy of contract highlighting the points that are contrary to the procedure they followed, copy of emails requesting cancellation, additional charges for PPC on dates post cancellation request.

And include a summary letter just stating as per attached documents please can you confirm why I was charged after I requested cancellation despite the fact that it is not stipulated in the contract blah blah blah.

Its important to provide evidence for everything and its also important to provide a clear question for them to answer at the end of the letter.

Then once thats done, don't respond any more to them, unless they can come up with a good answer - if they refuse to answer its an admission of guilt and you can keep that as ammo if the case ever goes further, if they do answer then you have lured them into an argument and they are basically agreeing, without saying it, that they will need to iron out these queries before receiving money - you could drag that on forever.

As mentioned above, they are never going to collect on this debt when you are in a different country anyway.

Do you have in contract that you can cancel the contract anytime in between?

If you signed a contract stating that you would pay 400 per month and tied into a months cancellation then I would have thought that means you're signing in to pay a minimum of 400. Just because you cancelled before that month was out does not mean you're not liable for the additional spend.

Though if you have proof that they were sending bot traffic that probably qualifies as a breach of contract anyway.

As others have said, I doubt they will collect on it, especially with you in a different country. What is 600Ł in £ - would it even be worth their while collecting on it?

Of course they can take this further. A UK business contract will be subject to UK law, so just because you cancel there may be specific requirements before this kicks in.

Given the level of debt involved (600 quid) id say the chances of ever getting taken to court is pretty much zero...

they are just scaring in hopes that they can get something out of you. all the emails that they send you is probably a template they send to all of their clients they scam.
just ignore them, even if you are in UK they won't take this further, hiring a lawyer and following this in court cost way more than what they want...
don't let them bully you, completely ignore them, they can't do shit. you have enough evidence that if they even go to court they can't win... internet laws are very complex and usually in favor of clients.
