I want to ask if I am allowed to make upload a video from another person from instagram but credit him, is it still considered copyright infringement? Or do I need to have their permission to upload that video.

The idea is to promote an affiliate video.

I am no lawyer, but unless the video has been listed as free to use with attribution, you'd still be infringing on the creator's copyright.

I do not think you will face copyright very soon if he is a very small guy but its best to have his consent before using his content as who know when a small infrignment complaint can bring your channel down.
